1.3    "Sec. 36. Minnesota Statutes 2007 Supplement, section 326.841, is amended to read:
1.4326.841 MANUFACTURED HOME INSTALLERS.
1.5    (a) Manufactured home installers are subject to all of the requirements of sections
1.6326.83 to 326.98, except for the following:
1.7    (1) manufactured home installers are not subject to the continuing education
1.8requirements of section 326.87, but are subject to the continuing education requirements
1.9established in rules adopted under section 327B.10
and must satisfy the continuing
1.10education requirement under 327B.10 related to plumbing issues prior to issuance of
1.11a license by the commissioner;
1.12    (2) the examination requirement of section 326.89, subdivision 3, for manufactured
1.13home installers shall be satisfied by successful completion of a written examination
1.14administered and developed specifically for the examination of manufactured home
1.15installers. The examination must be administered and developed by the commissioner. The
1.16commissioner and the state building official shall seek advice on the grading, monitoring,
1.17and updating of examinations from the Minnesota Manufactured Housing Association;
1.18    (3) a local government unit may not place a surcharge on a license fee, and may not
1.19charge a separate fee to installers;
1.20    (4) a dealer or distributor who does not install or repair manufactured homes is
1.21exempt from licensure under sections 326.83 to 326.98;
1.22    (5) the exemption under section 326.84, subdivision 3, clause (5), does not apply; and
1.23    (6) manufactured home installers are not subject to the contractor recovery fund
1.24in section 326.975.
1.25    (b) The commissioner may waive all or part of the requirements for licensure
1.26as a manufactured home installer for any individual who holds an unexpired license or
1.27certificate issued by any other state or other United States jurisdiction if the licensing
2.1requirements of that jurisdiction meet or exceed the corresponding licensing requirements
2.2of the department.
2.3EFFECTIVE DATE.This section is effective the day following final enactment.

2.4    Sec. 37. Minnesota Statutes 2007 Supplement, section 326.86, subdivision 1, is
2.5amended to read:
2.6    Subdivision 1. Licensing fee. The licensing fee for persons licensed pursuant to
2.7sections 326.83 to 326.98, except for manufactured home installers, is $100 per year.
2.8The licensing fee for manufactured home installers under section 326.841 is $300 for a
2.9three-year period."

2.11    "Sec. 37. Minnesota Statutes 2007 Supplement, section 326.97, subdivision 1a, is
2.12amended to read:
2.13    Subd. 1a. Annual renewal. Any license issued or renewed after August 1, 1993,
2.14must be renewed annually except for a manufactured home installers license which shall
2.15have a renewal period of three-years, effective for all renewals and new licenses issued
2.16after December 31, 2008.."

2.19    Subdivision 6. Exterior connections. Persons licensed as manufactured home
2.20installers under Minnesota Statutes, chapter 327B are not required to be licensed under
2.21Minnesota Statutes, sections 326B.42 to 326B.49 when connecting the exterior building
2.22drain sewer outlets to the above ground building sewer system and when connecting
2.23the exterior water line to the above ground water system to the manufactured home as
2.24described in National Manufactured Housing Construction and Safety Standards Act
2.25of 1974, 42 U.S.C. 5401 et seq. No additional licensure, bond, or insurance related
2.26to the scope of work permitted under this subdivision may be required of a licensed
2.27manufactured home installer by any unit of government.
2.28EFFECTIVE DATE.This section is effective the day following final enactment."

2.30    "Sec. 48. Minnesota Statutes 2006, section 327.32, subdivision 1, is amended to read:
2.31    Subdivision 1. Requirement. No person shall sell, or offer for sale, in this state,
2.32any manufactured home manufactured after July 1, 1972, manufacture any manufactured
2.33home in this state or park install for occupancy any manufactured home manufactured
3.1after July 1, 1972, in any manufactured home park in this state unless the manufactured
3.2home complies with the Manufactured Home Building Code and:
3.3    (a) Bears a seal issued by the commissioner, and is, whenever possible, accompanied
3.4by a certificate by the manufacturer or dealer, both evidencing that it complies with the
3.5Manufactured Home Building Code; or
3.6    (b) If manufactured after June 14, 1976, bears a label as required by the secretary.

3.7    Sec. 47. Minnesota Statutes 2006, section 327.33, is amended by adding a subdivision
3.8to read:
3.9    Subd. 2a. Construction seal fees. Replacement manufactured home or accessory
3.10structure construction seal fees, including certificates, are $30 per seal.
3.11    Subd. 2b. Installation seal fees. Manufactured home installation seal, including
3.12anchoring and support fees, including certificates, are $80.
3.13    Subd. 2c. Temporary installation certificate fees. A temporary certificate fee
3.14is $2 per certificate.
3.15    Subd. 2d. Label fee. The United States Department of Housing and Urban
3.16Development label fee shall be paid by the manufacturer to the secretary.
3.17    Subd. 2e. Seal order shipping and handling fee. The shipping and handling fee
3.18for each order of seals is the current postage rate plus a $3 handling fee."

3.20    "Sec. 48. Minnesota Statutes 2006, section 327B.06, subdivision 1, is amended to read:
3.21    Subdivision 1. Retention. A dealer shall retain for three five years copies of all
3.22listings, deposit receipts, credit applications, contracts, disclosure forms, canceled checks,
3.23trust account records and other documents reasonably related to carrying on the business
3.24of a dealer. The retention period shall run from the date of the closing of the transaction or
3.25from the date of the listing if the transaction is not consummated."
