1.3    "Section 1. Laws 2008, chapter 154, article 9, section 23, is amended to read:
1.4    Sec. 23. CITY OF FRIDLEY; TAX INCREMENT FINANCING DISTRICT;
1.5SPECIAL RULES.
1.6    (a) If the city elects upon the adoption of a tax increment financing plan for a district,
1.7the rules under this section apply to a one or more redevelopment tax increment financing
1.8district districts established by the city of Fridley or the housing and redevelopment
1.9authority of the city. The area within which the redevelopment tax increment district
1.10districts may be created includes the following parcels and adjacent railroad property
1.11and shall be referred to as the Northstar Transit Station District Project Area: parcel

1.20    (b) The requirements for qualifying a redevelopment tax increment district under
1.21Minnesota Statutes, section 469.174, subdivision 10, do not apply to the parcels located
1.22within the Northstar Transit Station District Project Area, which are deemed eligible for
1.23inclusion in a redevelopment tax increment district.
1.24    (c) In addition to the costs permitted by Minnesota Statutes, section 469.176,
1.25subdivision 4j
, eligible expenditures within the Northstar Transit Station District Project
1.26Area include those costs necessary to provide for the construction and land acquisition
2.1for a tunnel under the Burlington Northern Santa Fe railroad tracks to allow access to the
2.2Northstar Commuter Rail.
2.3    (d) The limitations on spending increments outside of the district under Minnesota
2.4Statutes, section 469.1763, subdivision 2, do not apply, but increments may only be
2.5expended on improvements or activities within the area defined in paragraph (a).
2.6    (d) (e) Notwithstanding the provisions of Minnesota Statutes, section 469.1763,
2.7subdivision 2
, the city of Fridley may expend increments generated from its tax increment
2.8financing districts Nos. 11, 12, and 13 for costs permitted by paragraph (c) and Minnesota
2.9Statutes, section 469.176, subdivision 4j, outside the boundaries of tax increment
2.10financing districts Nos. 11, 12, and 13, but only within the Northstar Transit Station
2.11District Project Area.
2.12    (e) (f) The five-year rule under Minnesota Statutes, section 469.1763, subdivision 3,
2.13does not apply to the Northstar Transit Station District Project Area or to tax increment
2.14financing districts Nos. 11, 12, and 13.
2.15    (f) (g) The use of revenues for decertification under Minnesota Statutes, section
2.16469.1763, subdivision 4 , does not apply to tax increment financing districts Nos. 11,
2.1712, and 13.
2.18    (h) The authority to approve tax increment financing plans and to establish one or
2.19more tax increment financing districts under this section expires on December 31, 2017.
2.20EFFECTIVE DATE.This section is effective upon approval by the governing body
2.21of the city of Fridley and upon compliance by the city with Minnesota Statutes, section
2.22645.021, subdivision 3."
