1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. [325F.172] DEFINITIONS.
1.4    For the purposes of sections 325F.172 to 325F.175, the following terms have the
1.5meanings given them.
1.6    (a) "BBP" means benzyl butyl phthalate, CAS # 85-68-7.
1.7    (b) "Child" means a person under three years of age.
1.8    (c) "Children's product" means a product designed or intended by a manufacturer to
1.9be used by a child:
1.10    (1) as a toy or an article of clothing;
1.11    (2) to facilitate sleep, relaxation, or feeding; or
1.12    (3) to be rubbed, poured, sprinkled , sprayed on, introduced into, or otherwise
1.13applied to the human body or any part thereof, including any article used as a component
1.14of such a product.
1.15    (d) "DBP" means di-n-butyl phthalate, CAS # 84-74-2.
1.16    (e) "DEHP" means di (2-ethylhexyl) phthalate, CAS # 117-81-7.
1.17    (f) "DIDP" means di-isodecyl phthalate, CAS # 26761-40-0.
1.18    (g) "DINP" means di-iso-nonyl phthalate, CAS # 71549-78-5.
1.19    (h) "DNOP" means di-n-octyl phthalate, CAS # 117-84-6.
1.20EFFECTIVE DATE.This section is effective the day following final enactment.

1.21    Sec. 2. [325F.173] BISPHENOL-A IN CHILDREN'S PRODUCTS; BAN.
1.22    Subdivision 1. Findings. The legislature finds that bisphenol-A is an
1.23estrogen-mimicking endocrine disrupting chemical used in the production of epoxy resins
1.24and polycarbonate plastics used in many food and drink packaging applications, such
1.25as lacquers to coat food cans, bottle tops, toys, baby bottles, and drinking cups. The
1.26legislature further finds that bisphenol-A has been shown to have hormone disrupting
2.1effects and exposure is linked with risks for adverse effects on reproduction and
2.2development, insulin resistance and cancer.
2.3    Subd. 2. Prohibition. Beginning January 1, 2009, no person may sell or offer for
2.4initial sale at retail in this state a children's product that contains bisphenol-A.
2.5EFFECTIVE DATE.This section is effective the day following final enactment.

2.6    Sec. 3. [325F.174] PHTHALATES IN CHILDREN'S PRODUCTS; BAN.
2.7    Subdivision 1. Findings. The legislature finds that phthalates are a class of
2.8chemicals used to provide flexibility to polyvinyl chloride (PVC) plastic, including
2.9teethers, toys, and soft plastic books, and to bind fragrance to cosmetic children's products.
2.10The legislature further finds that phthalates have been shown to have hormone disrupting
2.11effects and that exposure to phthalates is linked to risks for respiratory problems and
2.12adverse effects on organs, reproduction and development.
2.13    Subd. 2. Prohibition. (a) Beginning January 1, 2009, no person may sell or offer
2.14for initial sale at retail in this state a children's product that contains DEHP, DBP, or BBP
2.15in concentrations exceeding 0.1 percent, including plastic tubing or a container used to
2.16deliver a solution intravenously to a child under three years of age.
2.17    (b) Beginning January 1, 2009, no person or entity may sell or offer for initial sale at
2.18retail in this state any children's product that can be placed in a child's mouth and contains
2.19DINP, DIDP, or DNOP in concentrations exceeding 0.1 percent.
2.20EFFECTIVE DATE.This section is effective the day following final enactment.

2.21    Sec. 4. [325F.175] REPLACEMENT CHEMICALS.
2.22    A manufacturer shall not replace bisphenol-A or phthalates as a result of the
2.23prohibitions in sections 325F.173 or 325F.174 with a chemical that is:
2.24    (1) classified as "known to be a human carcinogen" or "reasonably anticipated to be
2.25a human carcinogen" in the most recent Report on Carcinogens published by the National
2.26Toxicology Program in the United States Department of Health and Human Services; or
2.27    (2) identified by the federal Environmental Protection Agency as causing birth
2.28defects, or reproductive or environmental harm.
2.29EFFECTIVE DATE.This section is effective the day following final enactment.

2.30    Sec. 5. [325F.176] PARTICIPATION IN INTERSTATE CLEARINGHOUSE.
2.31    The Minnesota Pollution Control Agency may participate in the establishment and
2.32implementation of a multistate clearinghouse to identify children's products containing
3.1bisphenol-A and phthalates and to evaluate safer alternatives that may be substituted
3.2for those chemicals.
3.3EFFECTIVE DATE.This section is effective the day following final enactment."
3.4Amend the title accordingly
