1.3Page 1, after line 24, insert:

1.4    "Sec. 2. [60K.365] PRODUCER TRAINING REQUIREMENTS FOR
1.5LONG-TERM CARE PARTNERSHIP PROGRAM INSURANCE PRODUCTS.
1.6    (a) An individual may not sell, solicit, or negotiate long-term care insurance
1.7unless the individual is licensed as an insurance producer for accident and health or
1.8sickness insurance or life insurance and has completed an initial training course and
1.9ongoing training every 24 months thereafter. The training shall meet the requirements of
1.10paragraph (b).
1.11    (b) The initial training course required by this subdivision shall be no less than
1.12eight hours and the ongoing training courses required by this subdivision shall be no less
1.13than four hours every 24 months. The courses shall be approved by the Department of
1.14Commerce and may be approved as continuing education courses under section 60K.56.
1.15The courses shall consist of topics related to long-term care insurance, long-term care
1.16services, and, if applicable, qualified state long-term care insurance partnership programs,
1.17including, but not limited to:
1.18    (1) state and federal regulations and requirements and the relationship between
1.19qualified state long-term care insurance partnership programs and other public and private
1.20coverage of long-term care services, including Medicaid;
1.21    (2) available long-term care services and providers;
1.22    (3) changes or improvements in long-term care services or providers;
1.23    (4) alternatives to the purchase of private long-term care insurance;
1.24    (5) the effect of inflation on benefits and the importance of inflation protection; and
1.25    (6) consumer suitability standards and guidelines.
2.1    The training required by this subdivision shall not include training that is insurer or
2.2company product specific or that includes any sales or marketing information, materials,
2.3or training, other than those required by state or federal law.
2.4    (c) Insurers shall obtain verification that a producer has received the training
2.5required by this subdivision before a producer is permitted to sell, solicit, or negotiate the
2.6insurer's long-term care insurance products. Insurers shall maintain records verifying
2.7that the producer has received the training contained in this subdivision and make that
2.8verification available to the commissioner upon request.
2.9    (d) Currently licensed producers must complete the initial training course by January
2.101, 2008."
2.11Renumber the sections in sequence and correct the internal references
2.12Amend the title accordingly
