1.3Page 37, delete section 9 and insert:

1.4    "Sec. 9. Minnesota Statutes 2006, section 473.1466, is amended to read:
1.5473.1466 TRANSPORTATION SYSTEM PERFORMANCE AUDIT;
1.6TRANSIT EVALUATION.
1.7    (a) In 1997 and every four years thereafter, the council shall provide for an
1.8independent entity selected through a request for proposal process conducted nationwide
1.9to do Prior to each major revision of the transportation policy plan, the council must carry
1.10out a performance audit evaluation of the commuting metropolitan area's transportation
1.11system as a whole. The performance audit evaluation must:
1.12    (1) evaluate the commuting area's ability to meet the region's needs need for
1.13effective and efficient transportation of goods and people, ;
1.14    (2) evaluate future trends and their impacts on the region's area's transportation
1.15system, and;
1.16    (3) assess the region's success in meeting the currently adopted regional
1.17transportation benchmarks; and
1.18    (4) include an evaluation of the regional transit system, including a comparison with
1.19peer metropolitan regions with regard to key operating and investment measurements.
1.20    (b) The council must update the evaluation of the regional transit system every
1.21two years.
1.22    (c) The council shall use the results of the performance evaluation to make
1.23recommendations for improving the system in each revision of the transportation policy
1.24plan. The performance audit must recommend performance-funding measures.
1.25    (b) In 1999 and every four years thereafter, the council must evaluate the
1.26performance of the metropolitan transit system's operation in relationship to the regional
1.27transit performance standards developed by the council.
2.1    (d) The council must conduct a peer review of the performance evaluation using at
2.2least two nationally recognized transportation and transit consultants.
2.3    (e) The council must submit the performance evaluation to the chairs and ranking
2.4minority members of the house and senate committees and divisions with jurisdiction over
2.5transportation finance and policy.
2.6EFFECTIVE DATE.This section is effective the day following final enactment."
