1.4    (a) For contract year 2008, the commissioner of the Department of Employee
1.5Relations shall ensure accuracy and transparency in cost level placement for health
1.6insurance by adjusting the methodology currently utilized in placing health care providers
1.7in specific cost level tiers. The commissioner shall: (1) make cost level placement criteria
1.8public and subject to review for accuracy; (2) place specific health care providers such as
1.9physicians, hospitals, and pharmacies in their own tier evaluated according to their own
1.10health care costs; (3) place hospitals and health care facilities tiered to their own costs;
1.11(4) make emergency care and urgent care the same cost structure across tiers in order to
1.12guarantee access at the same cost level throughout tiers; and (5) allow nonemergency
1.13care to be tiered.
1.14    (b) The cost level placement for health insurance shall be made public three months
1.15prior to making final placement decisions in order to allow providers to appeal the
1.16placement decision.
1.17    (c) The commissioner of the Department of Employee Relations (DOER) shall
1.18establish an appeals committee consisting of representatives from the following groups:
1.19one member from DOER; one member from Minnesota Community Measurement;
1.20one member from the Minnesota Medical Association; one member from the Citizen's
1.21Council on Health Care; and one member from the Minnesota Hospital and Health Care
1.23Renumber the sections in sequence and correct the internal references
1.24Amend the title accordingly
