1.3    "Section 1. Minnesota Statutes 2006, section 144.415, is amended to read:
1.4144.415 DESIGNATION OF SMOKING AREAS.
1.5    Smoking areas may be designated by proprietors or other persons in charge of public
1.6places, except in places in which smoking is prohibited by the fire marshal or by other law,
1.7ordinance or rule.
1.8    Where smoking areas are designated, existing physical barriers and ventilation
1.9systems shall be used to minimize the toxic effect of smoke in adjacent nonsmoking areas.
1.10In the case of public places consisting of a single room, the provisions of this law shall be
1.11considered met if one side of the room is reserved and posted as a no smoking area. No
1.12public place other than a bar shall be designated as a smoking area in its entirety. If a bar is
1.13designated as a smoking area in its entirety, this designation shall be posted conspicuously
1.14on all entrances normally used by the public. Notwithstanding any other law or rule to
1.15the contrary, any establishment that pays employees to serve food or beverages to retail
1.16customers in the ordinary course of business, may make available a designated non-public
1.17smoking room for use by customers in which no food or beverage will be served."
