1.3    "Sec. .... Minnesota Statutes 2006, section 299A.45, subdivision 1, is amended to read:
1.4    Subdivision 1. Eligibility. Following certification A person is eligible to receive
1.5educational benefits under this section if the person:
1.6    (1) is certified under section 299A.44 and in compliance with this section and rules
1.7of the commissioner of public safety and the Minnesota Office of Higher Education,;
1.8    (2) is enrolled in an undergraduate degree or certificate program after June 30, 1990,
1.9at an eligible Minnesota institution as provided in section 136A.101, subdivision 4;
1.10    (3) has not receive a baccalaureate degree or been enrolled full time for ten semesters
1.11or the equivalent, except that a student who withdraws from enrollment for active military
1.12service is entitled to an additional semester or the equivalent of eligibility; and
1.13    (4) is related in one of the following ways to a public safety officer killed in the
1.14line of duty on or after January 1, 1973:
1.15    (i) as a dependent children child less than 23 years of age and the;
1.16    (ii) as a surviving spouse of a public safety officer killed in the line of duty on
1.17or after January 1, 1973, are eligible to receive educational benefits under this section.
1.18To qualify for an award, they must be enrolled in undergraduate degree or certificate
1.19programs after June 30, 1990, at an eligible Minnesota institution as provided in section
1.20136A.101, subdivision 4. A student who withdraws from enrollment for active military
1.21service is entitled to an additional semester or the equivalent of grant eligibility. Persons
1.22who have received a baccalaureate degree or have been enrolled full time or the equivalent
1.23of ten semesters or the equivalent, whichever occurs first, are no longer eligible.; or
1.24    (iii) as a dependent child less than 30 years of age who has served on active military
1.25duty 181 consecutive days or more and has been honorably discharged or released to the
1.26dependent child's reserve or National Guard unit."
