1.3Page 24, after line 25, insert:

1.5    (a) This section applies to the land described in paragraph (b), which is owned by
1.6the city of Gilbert. The legislature finds that any fill placed along the shoreline below
1.7the historical high-water mark prior to the effective date of this section does not extend
1.8beyond the point of navigability and does not interfere with the public right of navigation
1.9or any other public right. Consistent with the common law of the state, the state shall not
1.10dispute the right of the owner of the land, or the owner's successors, to enjoy exclusive use
1.11of filled land in shallow waters abutting the land, subject only to the limitation that the
1.12owner or owner's successors shall not interfere with the public right of navigation.
1.13    (b) The land referred to in this section is described as follows:
1.14That part of the North Half of Government Lot 1, Section 35, Township 58 North,
1.15Range 17 West of the Fourth Principal Meridian, St. Louis County, Minnesota,
1.16described as follows: Starting at a pipe that is on the east side of Differding Road on
1.17the north line of the plat of Birch View and assuming that the north line is East and
1.18West, thence running North 49 degrees 56 minutes West a distance of 291.00 feet to
1.19the place of beginning; thence running South 55 degrees 19 minutes West a distance
1.20of 135 feet to the shore of Ely Lake; Starting from the place of beginning, thence
1.21running North 29 degrees 01 minutes West a distance of 436.50 feet; thence running
1.22North 87 degrees 24 minutes West a distance of 302 feet to the shore of Ely Lake;
1.23thence running along the shore to the intersection with the first described."
1.24Renumber the sections in sequence and correct the internal references
1.25Amend the title accordingly
