MINUTES

Representative Carlson, Chair of the Ways and Means Committee, called the meeting to order at 10:12 A.M. on Monday, March 31, 2014, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Paymar moved approval of the minutes of Friday, March 28, 2014. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Budget Resolution Adopted by the Ways and Means Committee March 4, 2014 and Amended by the Ways and Means Committee March 17, 2014 (See attached document CS-RES06-1)

Rep. Carlson moved to amend the CS-RES06-1 Budget Resolution. (See attached Amendment CS-RES06A6)

Rep. Carlson explained Amendment CS-RES06A6.

A discussion followed regarding Amendment CS-RES06A6.

Bill Marx, Fiscal Analyst, responded to questions regarding Amendment CS-RES06A6.

Rep. Carlson renewed the motion to amend the CS-RES06-1 Budget Resolution with Amendment CS-RES06A6). THE MOTION PREVAILED.

Bill Marx explained an administrative function of the budget resolution regarding the Agriculture subtotal and staff is directed to make that change.

Chair Carlson renewed the motion that HF3172 (Carlson) Supplemental Appropriations bill, as amended, be recommended to be placed on the General Register.

Rep. Atkins moved to amend HF3172, as amended, and insert the contents of HF3264, First Engrossment.

Rep. Atkins presented HF3264, First Engrossment (Atkins) Minnesota Racing Commission funding provided, and money appropriated.

Rep. Atkins renewed the motion to amend HF3172, as amended, by inserting the contents of HF3264, First Engrossment, as part of an article of Commerce. THE MOTION PREVAILED.

Rep. Atkins moved to amend HF3172, as amended, and insert the contents of HF3183, First Engrossment.

Rep. Atkins presented HF3183, First Engrossment (Radinovich) Mille Lacs Tourism Council grant money transferred from Explore Minnesota Toruism.

Rep. Atkins renewed the motion to amend HF3172, as amended, by inserting the contents of HF3183, First Engrossment as part of an article of Commerce. THE MOTION PREVAILED.

Rep. Marquart moved to amend HF3172, as amended, and insert the contents of HF3171, Second Engrossment.

Rep. Marquart presented HF3171, Second Engrossment (Marquart) Supplemental K-12 Finance bill.

Bill Marx responded to questions regarding the fiscal impact of HF3171, Second Engrossment.

Rep. Marquart renewed the motion to amend HF3172, as amended, by inserting the contents of HF3171, Second Engrossment, as separate articles on K-12 Education Finance. THE MOTION PREVAILED.

Rep. Huntley moved to amend HF3172, as amended, and insert the contents HF2150, First Engrossment.

Rep. Huntley moved to amend HF 2150, First Engrossment. (See attached Amendment H2150A64) THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Huntley moved to amend HF 2150, First Engrossment, as amended. (See attached Amendment H2150A62) THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Huntley moved to amend HF 2150, First Engrossment, as amended. (See attached Amendment H2150A63-1).

Rep. Huntley moved to amend Amendment H2150A63-1 with Amendment H2150A66). (See attached Amendment H2150A66).

Randall Chun, House Research, explained and responded to questions regarding Amendments H2150A63-1 and H2150A66.

Doug Berg, Fiscal Analyst, responded to questions regarding the fiscal impact of the proposed amendments.

THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Rep. Huntley renewed the motion to amend HF 2150, First Engrossment, as amended, with Amendment H2150A63-1, as amended). THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Rep. Huntley moved to amend HF 2150, First Engrossment, as amended. (See attached Amendment H2150A67.) THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Huntley presented HF2150, First Engrossment, as amended. (Huntley) Supplemental Health and Human Services Finance bill.

Doug Berg presented and responded to questions regarding HF2150, First Engrossment, as amended.

Rep. Huntley renewed the motion to amend HF3172, as amended, by inserting the contents of HF2150, First Engrossment, as amended, as separate articles on Health and Human Services. THE MOTION PREVAILED.

Rep. Wagenius moved to amend HF3172, as amended, and insert the contents of HF3158, First Engrossment.

Rep. Wagenius moved to amend HF3158, First Engrossment. (See attached Amendment H3158A28). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Wagenius moved to amend HF3158, First Engrossment, as amended. (See attached Amendment H3158A29)

Rep. Wagenius incorporated an oral amendment to Amendment H3158A29, as follows:

Page 1, line 6, after “that” insert “any of” and delete “use” and insert “uses” and delete “affects” and insert “affect”
Page 1, line 7, delete everything after “ground water” and insert a period

Rep. Wagenius moved to amend HF3158, First Engrossment, as amended. (See attached Amendment H3158A30)

Page 1, line 3, delete “$1,000 in 2015 is to” and insert “The Commissioner shall”

Michelle Mitchell, Minnesota Management and Budget, responded to questions regarding the fiscal note for Amendment H3158A31.

Rep. Wagenius renewed the motion to amend HF3172, as amended by inserting the contents of HF3158, First Engrossment, as amended, as separate articles on Environment, Natural Resources and Agriculture. THE MOTION PREVAILED.

Rep. Clark presented HF2246 (Clark) Housing; high-risk adults appropriation modified.

Rep. Clark moved to amend HF3172, as amended, by inserting the contents of HF2246, as a separate article on Housing. THE MOTION PREVAILED.

Rep. Clark moved to amend HF3172, as amended, by inserting the contents of HF2112, First Engrossment.

Rep. Clark moved to amend HF2112, First Engrossment, as follows:

Page 3 and 4, Delete Section 4
Amend the title accordingly

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Clark presented HF2112, First Engrossment, as amended (Clark) Housing Opportunities Made Equitable (HOME) pilot project created, and money appropriated.

Rep. Clark renewed the motion to amend HF3172, as amended, by inserting the contents of HF2112, First Engrossment, as amended, as a separate article on Housing. THE MOTION PREVAILED.

Rep. Wagenius moved to reconsider the previously adopted HF3158, First Engrossment, as amended. THE MOTION PREVAILED.

Rep. Wagenius moved to amend HF3158, First Engrossment, as amended.

Bill Marx explained the amendment, as follows:

Page 4, after line 17, insert, “The base for this program from the environmental fund is $744,000 in fiscal year 2016 and $495,000 in fiscal year 2017.”

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

I will direct staff to make and technical changes to HF3172, as amended, that may be necessary to reflect the will of the committee when putting the bill together.

Chair Carlson renewed the motion that HF3172, as amended, be recommended to be placed on the General Register and the staff directed to make technical corrections as necessary to HF3172, as amended. THE MOTION PREVAILED.

Rep. Pelowski moved that HF2701, Second Engrossment, be recommended to be placed on the General Register.

Rep. Pelowski moved to amend HF2701, Second Engrossment. (See attached amendment H2701A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Pelowski presented HF2701, Second Engrossment, as amended (Pelowski) Disaster assistance contingency account created; unused disaster relief appropriation transfer to contingency account required; a disaster relief cost-share relationship established between the state, local governments, and American Indian tribes and bands; state public disaster assistance authorized in the absence of federal assistance; and money appropriated.

Rep. Pelowski moved to amend HF2701, Second Engrossment, as amended, as follows:

Page 9, Delete Article 3

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Pelowski renewed the motion that HF2701, Second Engrossment, as amended, be recommended to be placed on the General Register. THE MOTION PREVAILED.

Rep. Mahoney moved that HF2658, Second Engrossment, be recommended to be placed on the General Register.

Rep. Mahoney presented HF2658, Second Engrossment (Mahoney) Work Comp Advisory Council Recommendations.

Rep. Mahoney renewed the motion that HF2658, Second Engrossment, be recommended to be placed on the General Register. THE MOTION PREVAILED.

Chair Carlson moved that HF2180, Fourth Engrossment, be recommended to be placed on the General Register.

Chair Carlson moved to amend HF2180, Fourth Engrossment. (See attached amendment H2180A31). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Murphy, E. presented HF2180, Fourth Engrossment, as amended (E. Murphy) School district employee health coverage provisions amended, and money appropriated.

Chair Carlson renewed the motion that HF2180, Fourth Engrossment, as amended, be recommended to be placed on the General Register. THE MOTION PREVAILED.
Nancy Conley, Committee Administrator, made announcements regarding the upcoming Ways and Means Committee schedule.
