MINUTES

Representative Abeler, Chair of the Health and Human Services Finance Committee, called the meeting to order at 10:21 A.M. on March 28, 2012, in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Chair Abeler called the meeting to order at 10:21 A.M.

A quorum was present.

HF1993 (Barrett) Advisory council provisions modified.

Chair Abeler moved that HF1993 be recommended to pass and sent to the General Register.

Chair Abeler renewed his motion that HF1993 be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

HF2223 (Abeler) Alcohol and drug counselor and licensed counselor licensing provisions changed.

Chair Abeler moved that HF2223 be recommended to pass and sent to the General Register.

Chair Abeler renewed his motion that HF2223 be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

HF2060 (Mack) Medical assistance coverage provided for community paramedic services.

Representative Gottwalt moved that HF2060 be recommended to pass and sent to the Ways and Means Committee.

Representative Gottwalt renewed his motion that HF2060 be recommended to pass and re-referred to the Ways and Means Committee. THE MOTION PREVAILED.

HF2097 (Peppin) Child care accreditation provisions modified.

Vice Chair Kiffmeyer moved that HF2097 be recommended to pass and sent to the General Register.

Vice Chair Kiffmeyer moved the H2097DE1 amendment

Vice Chair Kiffmeyer moved to incorporate the H2097DE1 amendment into HF2097. THE MOTION PREVAILED.

Chair Abeler renewed his motion that HF2097 be recommended to pass, as amended, and sent to the General Register. THE MOTION PREVAILED.

HF2379 (Gottwalt) Licensing moratorium exception provided for adult foster care homes, and certification requirements established.

Representative Gottwalt moved that HF2379 be recommended to pass and sent to the General Register.

Representative Gottwalt moved the H2379A2 amendment.

Chair Abeler, Sue Abderholden, NAMI-MN, testified on HF2379.

Representative Gottwalt moved to incorporate the H2379A2 amendment into HF2379. THE MOTION PREVAILED.

Representative Gottwalt renewed his motion that HF2379 be recommended to pass, as amended, and sent to the General Register. THE MOTION PREVAILED.

HF2412 (Gottwalt) Managed care plan financial reporting changes made, and an annual independent third-party audit required.

Representative Gottwalt moved that HF2412 be recommended to pass and sent to the General Register.

Representative Gottwalt moved the H2412A12-1 amendment.

Representative Gottwalt moved to orally amend the H2412A12-1 amendment as follows:
Page 2, Line 2.20, Delete "regarding contracted services"
Page 3, Line 3.11, Delete "shall" and insert "may"
Page 3, Line 3.11, after "and", insert "shall discontinue"
Page 3, Line 3.16, after "health", insert ", commissioner of commerce,"
Representative Gottwalt incorporated the oral amendment into H2412A12-1.

Representative Laine moved the H2412A15-1 amendment.

Representative Laine moved to incorporate the H2412A15-1 amendment into H2412A12-1 and requested a roll call vote.

The following four members voted in favor of the motion:
FRITZ, LAINE, LIEBLING, LOEFFLER

The following thirteen members voted against the motion:
ABELER, KIFFMEYER, ANDERSON, FRANSON, GOTTWALT, HAMILTON, HOSCH, HUNTLEY, LANNING, MCDONALD, MCELFATRICK, MURPHY, SCHOMACKER

Absent: LOHMER, MACK, SLAWIK

THE MOTION DID NOT PREVAIL (4-13).

Representative Loeffler moved to orally amend the H2412A12-1 amendment as follows:
Delete Lines 3.26-3.29
Representative Loeffler withdrew her oral amendment.

Representative Gottwalt, Dr. Jim Golden, Assistant Commissioner, DHS, Dave Feinwachs, Dr. Mike Flynn, MN Dental Association, Scott Leitz, DHS, Matthew Collie, Legislative Liaison, MDH, Judy Cook, Cook Girard Associates, Michele Barrette, Minnesota Podiatric Medical Association, Twila Brase, Citizens Council for Health Freedom, Geoff Bartsh, Medica, and Jim Nobles, Legislative Auditor, testified on HF2412.

Representative Gottwalt moved to incorporate the H2412A12-1 amendment, as amended, into HF2412. THE MOTION PREVAILED.

Representative Gottwalt moved the H2412A14 amendment.

Representative Gottwalt moved to incorporate the H2412A14 amendment into HF2412. THE MOTION PREVAILED.

Representative Gottwalt moved the H2412A13 amendment.

Representative Gottwalt withdrew the H2412A13.

Representative Gottwalt renewed his motion that HF2412 be recommended to pass, as amended, and sent to the General Register. THE MOTION PREVAILED.

HF2232 (Drazkowski) Department of Human Services data sharing required, public assistance fraud investigation required, and eligibility determinations required.

Chair Abeler moved that HF2232 be recommended to pass and sent to the General Register.

Chair Abeler moved the H2232A7 amendment.

Chair Abeler moved to orally amend the H2232A7 amendment as follows:
Page 3, Line 13, Delete "April" and insert "December"
Page 3, Line 15, Delete "January" and insert "July"
Chair Abeler incorporated the oral amendment into the H2232A7 amendment.

Chair Abeler moved to incorporate the H2232A7 amendment into HF2232. THE MOTION PREVAILED.

Kim DeFranco, MN Coalition for a People's Bailout, testified on HF2232.

Chair Abeler renewed his motion that HF2232 be recommended to pass, as amended, and sent to the General Register. THE MOTION PREVAILED.

HF1918 (Dean) State health care programs restructuring and reform plan in the event of federal changes to the Medicaid program required to be submitted by the commissioner of human services to the legislature.

Chair Abeler moved that HF1918 be recommended to pass and sent to the Ways and Means Committee.

Chair Abeler moved the H1918A1 amendment.

Chair Abeler moved to incorporate the H1918A1 amendment into HF1918. THE MOTION PREVAILED.

Representative Dean, and Twila Brase, Citizens Council for Health Freedom, testified on HF1918.

Chair Abeler renewed his motion that HF1918 be recommended to pass, as amended, and re-referred to the Ways and Means Committee. THE MOTION PREVAILED.

Representative Huntley moved that the minutes from the committee meeting on March 22nd , 2012, be approved. THE MOTION PREVAILED.

The meeting was adjourned at 11:52 A.M.
