MINUTES
Representative Denny McNamara, Chair of the Committee on Environment, Energy and Natural Resources Policy and Finance called the forty-second meeting to order at 8:22 a.m. on April 27, 2011, in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present at 8:22 a.m.

H.F. 1471 (Hortman) Electronic device recycling requirements.

Rep. McNamara moved that H.F. 1471 be recommended to pass and be re-referred to the Committee on Commerce and Regulatory Reform.

Rep. McNamara moved the H1471DE1 delete-all amendment to H.F. 1471. THE MOTION PREVAILED. The amendment was adopted.

Rep. Hortman presented H.F. 1471.

Garth Hinkle, MN Pollution Control Agency, Julie Ketchem, BFI Waste Management, Victoria Reinhardt, Ramsey County and Tony Kwilas, MN Chamber of Commerce, testified on H.F. 1471.

Rep. McNamara renewed his motion that H.F. 1471, as amended, be recommended to pass and be re-referred to the Committee on Commerce and Regulatory Reform. THE MOTION PREVAILED.

Rep. Torkelson assumed the gavel at 9:12 a.m.

H.F. 1097 (McNamara) Land acquisition by exchange provided; peatland protection, recreational vehicle enforcement provisions, local recreational vehicle enforcement provisions, local recreation grant cash match requirement, and Mineral Coordinating Committee modified; Blakeley State Wayside repealed, and money appropriated.

Rep. McNamara moved that H.F. 1097 be recommended to pass and be re-referred to the Committee on Government Operations and Elections.

Bob Meier, MN Department of Natural Resources testified on H.F. 1097.

Rep. McNamara renewed his motion that H.F. 1097, be recommended to pass and be re-referred to the Committee on Government Operations and Elections. THE MOTION PREVAILED.

H.F. 908 (Torkelson) Wetland Conservation Act modified.

Rep. Torkelson moved that H.F. 908 be recommended to pass and be re-referred to the Committee on Government Operations and Elections.

Rep. Torkelson moved the H0908DE4 delete-all amendment to H.F. 908. THE MOTION PREVAILED. The amendment was adopted.

Dave Weirens, MN Board of Water and Soil Resources and Lisa Frenette, Builders Association testified on H.F. 908

Rep. Torkelson renewed his motion that H.F. 908, as amended, be recommended to pass and be re-referred to the Committee on Government Operations and Elections. THE MOTION PREVAILED.

Rep. McNamara called a recess to the call of the chair at 9:58 a.m.

Rep. Torkelson reconvened the committee at 6:27 p.m. in room 300 N in the State Office Building.

H.F. 1451 (McNamara) Shallow lakes management report required.

Rep. McNamara moved that H.F. 1451 be recommended to pass and be re-referred to the General Register.

Ed Boggess, MN Department of Natural Resources and Jon Schneider, Ducks Unlimited testified on H.F. 1451.

Rep. Hansen moved to orally amend H.F. 1451 as follows:

Pg 1, line 14, after "lakes" add "and drainage laws under section 103 E.
Pg 1, line 17 after "species" add "including carp and the use of fish barriers"

THE MOTION PREVAILED. The amendment was adopted.

Rep. McNamara renewed his motion that H.F. 1451, as amended, be recommended to pass and be re-referred to the General Register. THE MOTION PREVAILED.

Rep. McNamara assumed the gavel at 6:52 p.m.

H.F. 1513 Wholesale energy rate payment provided for qualifying facility.

Rep. Torkelson moved that H.F. 1513 be recommended to pass and be re-referred to the General Register.

Rep. Torkelson moved the H1513DE1 delete-all amendment to H.F. 1513. THE MOTION PREVAILED. The amendment was adopted.

Rep. Torkelson moved the H1513A1 amendment. THE MOTION PREVAILED. The amendment was adopted.

Bill Grant, MN Department of Commerce and Jim Haler, South Central Electric testified on H.F. 1513

Rep. Torkelson moved that H.F. 1513 be laid over. THE MOTION PREVAILED.

Rep. Hancock moved that the minutes from the committee meeting on April 26, 2011 be adopted. The motion prevailed.

H.F. 1463 (Anderson, P) Waste Management Act modified.

Rep. Anderson moved that H.F. 1463 be recommended to pass and be re-referred to the General Register.

Rep. McNamara moved the H1463A1 amendment. THE MOTION PREVAILED. The amendment was adopted.

Rep. Anderson presented H.F. 1463.

Cathy Moeger, MN Pollution Control Agency, testified on H.F. 1463.

Rep. Anderson renewed his motion that H.F. 1451, as amended, be recommended to pass and be re-referred to the General Register. THE MOTION PREVAILED.
