MINUTES

Representative Hoppe, Chair of the Commerce and Regulatory Reform Committee, called the meeting to order at 2:35 pm on May 3, 2011, in the Basement hearing room of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Diane Anderson moved the minutes from April 29, 2011. The motion prevailed.

Representative Atkins moved HF0859 and recommended that it be passed and re-referred to the General Register.

McKenzie Prokosch from Choice Auto testified.

Representative Atkins moved amendment H0859A2. The motion prevailed. The amendment was adopted.

Representative Atkins renewed his motion that HF0859 be recommended to pass as amended and re-referred to the General Register. The motion prevailed.

Representative Hoppe handed the gavel to Representative Davids at 2:44 pm.

Representative Hoppe moved HF1394 and recommended that it be passed and re-referred to the General Register.

Representative Hoppe moved amendment H1394DE1.

Representative Hoppe moved an oral amendment to the amendment, deleting section 25 on page 12. The motion prevailed. The amendment to the amendment was adopted.

Representative moved amendment H1394A1 to the H1394DE1 amendment.

John Reich from the MN Chamber of Commerce testified.

Nich Schrader from Surplus Lines Association of MN testified.

Representative renewed his motion on amendment H1394A1 to the H1394DE1 amendment. The motion prevailed. The amendment was adopted.

Representative Hoppe moved amendment H1394A2 to amendment H1394DE1. The motion prevailed. The amendment was adopted.

Representative Hoppe moved an oral amendment to amendment H1394DE1. On line 4.2 after the word "certificates" insert "offered by the issuer" and on line 4.9 after "coverage" delete period and insert "if offered by the issuer." The motion prevailed. The oral amendment to the amendment was adopted.

Kathryn Kmit from MN Council on Health plans testified.

Representative Hoppe moved amendment H1394DE1 as amended. The motion prevailed. The amendment was adopted.

Peter Brage from Department of Commerce testified.

Tina Armstrong from Department of Commerce testified.

Representative Atkins moved amendment H1394A3.

Representative Atkins incorporated an oral amendment to the amendment, after the word "senate" on line 1.10, delete "and one appointee of the house Commerce Committee DFL lead" and insert period after "senate" in place of the comma. After the word house on line 1.9, delete the comma and replace it with "and."

Representative Hoppe moved that HF1394 as amended be laid over to the next Commerce Committee meeting. The motion prevailed.

Representative Hoppe moved HF1420 and recommended that it be passed and re-referred to the General Register.

Representative Hoppe moved amendment H1420DE1. The motion prevailed. The amendment was adopted.

Robert Johnson from the Insurance Federation of MN testified.

Marcus Marsh from MN Farm Mutual Insurance testified.

Representative Hoppe renewed his motion that HF1420 be recommended to pass as amended and re-referred to the General Register. The motion prevailed.

The meeting was adjourned at 3:36 pm.
