MINUTES


Karla Bigham, Vice- Chair of the Public Safety Policy & Oversight Committee, called to order the thirty-second meeting of the House Public Safety Policy & Oversight Committee at 1:06 pm on Thursday, March 4, 2010 in room 10 of the of the State Office Building, a quorum was present.

The Committee Legislative Assistant noted the roll.

Vice-Chair Bigham called for a motion to approve the minutes.

Rep. Shimanski moved to approve the minutes of March 2, 2010.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.

Rep. Drazkowski moved to approve the minutes of Feb. 25, 2010.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.


HF3081 (Hilstrom): Criminal sexual conduct in the first degree penalty increased.

Rep. Hilstrom moved that HF 3081 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

Rep. Hilstrom presented HF3081 and took questions from the committee.

The following individuals testified on behalf of HF3081 and took questions from the committee:

Rep. Lesch moved to amend HF3081 (see H3081A1).

Rep. Lesch presented the H3081A1 amendment and took questions from the committee.

Rep. Lesch withdrew the H3081 amendment.

The following individuals testified on HF3081 and took questions from the committee:

Rep. Hilstrom renewed her motion that HF 3081 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF3191 (Morrow): Sexual contact in secure treatment facilities included as criminal sexual conduct in the fourth degree.

Vice-Chair Bigham moved that HF3191 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

Rep. Morrow presented HF3191 and took questions from the committee.

Sheila Brandt, Department of Human Services, MN State Sex Offender Program, testified on behalf of HF3191 and took questions from the committee.

Vice-Chair Bigham renewed her motion that HF3191 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF3276 (Hilstrom): Criminal abuse of a vulnerable adult crime made a registrable offense under the predatory offender registration law.

Rep. Hilstrom moved that HF3276 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

Rep. Hilstrom presented HF3276 and took questions from the committee.

Tara Patet, St. Paul City Attorney’s Office, testified on behalf of HF3276 and took questions from the committee.

Rep. Hilstrom renewed her motion that HF3276 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Chair Hilstrom resumed the gavel at 2:11pm.

HF3174 (Bigham): Predatory offender registration law amended to address registrants living in homeless shelters and to clarify that the registration requirement for offenders who move out of state are suspended not terminated.

Rep. Bigham moved that HF3174 be recommended to pass and be placed on the General Register.

Rep. Bigham presented HF3174 and took questions from the committee.

The following individuals testified on behalf of HF3174 and took questions from the committee:

Melissa Reed, City of Minneapolis

Rep. Bigham moved to amend HF3174 (see H3174A2).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Bigham renewed her motion that HF3174 as amended, be recommended to pass and be placed on the General Register.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF3103 (Drazkowski): Child pornography related definition amended.

Rep. Drazkowski moved that HF3103 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

Rep. Drazkowski moved to amend HF3103 (see A10-2187).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Drazkowski presented HF3103 as amended and took questions from the committee.
