MINUTES


Debra Hilstrom, Chair of the Public Safety Policy & Oversight Committee, started the twenty-eighth meeting of the House Public Safety Policy & Oversight Committee at 1:22 pm on Thursday, February 18, 2010 in Room 10 of the of the State Office Building.

The Committee Legislative Assistant noted the roll.

Agenda:

HF2757 (Kahn): Measurement of the actual weight of controlled substance residue mandated for determining severity of controlled substance offenses.

Rep. Kahn presented HF2757 and took questions from the committee.

Ted Sampsell-Jones, Professor, William Mitchell College of Law, testified in support of HF2757 and took questions from the committee.

A quorum was present at 1:29 pm and the meeting was officially called to order.

Chair Hilstrom moved that HF2757 be laid over for possible inclusion in the Public Safety Policy & Oversight Omnibus Bill.

Rep. Kahn offered to amend HF2757 (see H2757DE1).

Jeff Diebel, Non-partisan House Research, explained the DE1 amendment.

Chair Hilstrom moved to amend HF2757 (see H2757DE1).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Scott Hersey, Dakota County Attorney’s Office, testified in opposition to H2757, as amended and took questions from the committee.

Chair Hilstrom laid HF2757 as amended, over for possible inclusion in the Public Safety Policy & Oversight Omnibus Bill.

HF2701 (Atkins): Firefighter related terms modified.

Vice-Chair Bigham moved that HF2701 be recommended to pass and be placed on the General Register.

Rep. Atkins presented HF2701 and took questions from the committee.

Vice-Chair Bigham assumed the gavel at 1:40 pm.
Tom Thornberg, Minnesota Professional Firefighters, testified in support of HF2701 and took questions from the committee.

Chair Hilstrom resumed the gavel at 1:42 pm.

Vice-Chair Bigham renewed her motion that HF2701 be recommended to pass and be placed on the General Register.
THE MOTION PREVAILED. THE BILL WAS PASSED.

HF2950 (Atkins): Deceptive practices prohibited in the sale of event tickets.

Chair Hilstrom moved that HF2950 be recommended to pass and be re-referred to the Committee on Commerce and Labor.

Rep. Atkins presented HF2950 and took questions from the committee.

Chair Hilstrom renewed her motion that HF2950 be recommended to pass and be re-referred to the Committee on Commerce and Labor.
THE MOTION PREVAILED. THE BILL WAS PASSED.

HF2888 (Bigham): Careless driving resulting in death penalty provided.

Rep. Bigham moved that HF2888 be recommended to pass and be re-referred to the Transportation and Transit Policy and Oversight Division.

Rep. Bigham, Rep. Morrow, and Rep. Garofolo presented HF2888 and took questions from the committee.

Rep. Bigham renewed her motion that HF2888 be recommended to pass and be re-referred to the Transportation and Transit Policy and Oversight Division.
THE MOTION PREVAILED. THE BILL WAS PASSED.

HF524 (Mullery): County jail reentry project established, and money appropriated.

Rep. Mullery moved that HF524 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

Rep. Mullery presented HF524 and took questions from the committee.

Rep. Mullery renewed his motion that HF524 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

HF2607 (Mullery): Detention placement options clarified for extended jurisdiction juveniles pending revocation hearings.

Rep. Mullery moved that HF2607 be recommended to pass and be placed on the General Register.

Rep. Mullery presented HF2607 and took questions from the committee.

Cal Saari, MN Corrections Association, testified in support of HF2607 and took questions from the committee.

Rep. Mullery renewed his motion that HF2607 be recommended to pass and be placed on the General Register.
THE MOTION PREVAILED. THE BILL WAS PASSED.

HF2618 (Mullery): Court required to provide a general notice of collateral sanctions to a juvenile before accepting a guilty plea.

Rep. Mullery moved that HF2618 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

Rep. Mullery presented HF2618 and took questions from the committee.

Mark Haase, Council on Crime & Justice, testified in support of HF2618 and took questions from the committee.

Cal Saari, MN Corrections Association, testified on HF2618 and took questions from the committee.

Rep. Mullery renewed his motion that HF2618 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.
THE MOTION PREVAILED. THE BILL WAS PASSED.

Rep. Kath moved to adopt the minutes of Feb. 9, 2010.
