MINUTES


Debra Hilstrom, Chair of the Public Safety Policy & Oversight Committee, started the seventeenth meeting of the House Public Safety Policy & Oversight Committee at 1:00 pm on Tuesday, March 10, 2009 in Room 10 of the of the State Office Building.

The Committee Legislative Assistant noted the roll.

Agenda:

HF589 (Lesch): Driver’s license reinstatement diversion pilot program created for individuals charged with driving without a valid license.

Rep. Lesch presented HF589 and took questions from the committee.

A quorum was present at 1:04 and the meeting was officially called to order.

Rep. Lesch moved that HF589 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

The following individuals testified in support of HF589 and took questions from the committee:
John Choi, City Attorney for St. Paul
Kori Land, City Attorney for South St. Paul, West St. Paul, & Inver Grove Heights

Rep. Lesch renewed his motion that HF589 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Chair Hilstrom laid HF589 over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

HF1039 (Smith): Provisions clarified for an inmate convicted for assaulting a correctional officer to serve sentence consecutive to the sentence for which they are imprisoned.

Chair Hilstrom moved that HF1039 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Smith presented HF1039 and took questions from the committee.

Lynn Dingle, Deputy Commissioner for Facilities, Minnesota Department of Corrections, testified in support of HF1039 and took questions from the committee.

Chair Hilstrom renewed her motion that HF1039 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

HF1144 (Bigham): Out-of-state juvenile placement reports repealed, Sentencing Guidelines Commission review of reports required.

Rep. Bigham moved that HF1144 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Bigham moved to amend HF1144 (see H1144-A1).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Bigham presented HF1144 and took questions from the committee.

Suzanne Alliegro, Minnesota Sentencing Guidelines Commission, testified in support of HF1144 and took questions from the committee.

Rep. Bigham renewed her motion that HF1144 be laid over as amended for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Chair Hilstrom laid HF1144 over, as amended for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

HF1274 (Rosenthal): Statewide Radio Board designated as Minnesota’s Interoperability Executive Committee.

Rep. Rosenthal moved that HF1274 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Rosenthal presented HF1274 and took questions from the committee.

Scott Wiggins, ARMER and 911 Program Director, testified in support of HF1274 and took questions from the committee.

Rep. Rosenthal renewed his motion that HF1274 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Chair Hilstrom laid HF1274 over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Bigham assumed the gavel at 1:40pm

HF1264 (Hilstrom): Trespass crime expanded to prohibit entry into areas cordoned off by peace officers.

Rep. Hilstrom moved that HF1264 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Hilstrom presented HF1264 and took questions from the committee.

Rep. Hilstrom moved to orally amend HF1264 as follows:

Page 3, line 5, after "subdivision" strike "2" and insert "1"
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Rep. Hilstrom renewed her motion that HF1264 be laid over as amended for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Chair Bigham laid HF1264 over as amended for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

HF702 (Hilstrom): Summary data collection and reporting required relating to decisions that affect a child’s status within the juvenile justice system.

Rep. Hilstrom moved that HF702 be recommended to pass and be re-referred to the Committee on Civil Justice.

Rep. Hilstrom presented HF702 and took questions from the committee.

The following individuals testified in support of HF702 and took questions from the committee:

Nekima Levy-Pounds, Professor, St. Thomas School of Law

Rep. Hilstrom renewed her motion that HF702 be recommended to pass and be re-referred to the Committee on Civil Justice.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Rep. Hilstrom announced to the committee that starting on March 12, 2009, meetings will start at 12:30 pm, that Thursday hearings may be extended into the evenings, and that the committee’s final prison tour will be on Friday, March 13, 2009 to Red Wing.

Rep. Kohls moved to reconsider the vote on HF702.
THE MOTION DID NOT PREVAIL.

Rep. Kohls moved for a division vote.

Chair Bigham called for a motion to adopt the minutes of March 5, 2009.

Rep. Olin moved to adopt the minutes of March 5, 2009.
