MINUTES


Debra Hilstrom, Chair of the Public Safety Policy & Oversight Committee, started the thirteenth meeting of the House Public Safety Policy & Oversight Committee at 1:03 pm on Tuesday, February 24, 2009 in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF267 First Engrossment (Hortman): Motor vehicle restraint required for child passengers under the age of eight and shorter than four feet nine inches and seat belt requirements modified accordingly.

Rep. Hortman presented HF267 En.1 and took questions from the committee.

A quorum was present at 1:07pm and the meeting was officially called to order.

Rep. Paymar moved that HF267 First Engrossment be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF755 (Simon): Felony theft added to racketeering statute, and identity theft added to the enhanced penalty for theft.

Rep. Bigham moved that HF755 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

Rep. Simon presented HF755 and took questions from the committee.

Rep. Bigham renewed her motion that HF755 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF668 (Morrow): Postcrash procedures provided for school buses in accidents.
Chair Hilstrom moved that HF668 be recommended to pass and be re-referred to the Transportation and Transit Policy and Oversight Division.
Rep. Morrow presented HF668 and took questions from the committee.

The following individuals testified in support of HF668 and took questions from the committee:

Gary Botzek, Minnesota School Bus Operators Association
Chair Hilstrom renewed her motion that HF668 be recommended to pass and be re-referred to the Transportation and Transit Policy and Oversight Division.
THE MOTION PREVAILED AND THE BILL WAS PASSED.
Rep. Bigham assumed the gavel at 2:21pm.

HF509 (Hilstrom): Public defender representation provisions modified.
Rep. Hilstrom moved that HF509 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.
Rep. Hilstrom moved to orally amend HF509 as follows:
Page 1, delete section 2.
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.
Rep. Hilstrom presented HF509 as amended, and took questions from the committee.
Kevin Kajer, Board of Public Defense, testified in support of HF509 and took questions from the committee.
Rep. Hilstrom renewed her motion that HF509 as amended, be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.
THE MOTION PREVAILED AND THE BILL WAS PASSED.
Chair Bigham called for a motion to approve the minutes of February 17, 2009.
Rep. Kelly moved to approve the minutes of February 17, 2009.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.
The meeting was adjourned at 2:32pm.
