MINUTES



Representative Ron Shimanski, Vic-Chair of the Crime Victims & Criminal Records Division, started the ninth meeting at 8:35 am on Friday, February 26, 2010 in the Basement of the State Office Building. A quorum was present and the meeting was called to order.

The Committee Legislative Assistant noted the roll.

Agenda/ Action:

Vice-Chair Shimanski called for a motion to approve the minutes of February 19, 2010.

Rep. Kath moved to approve the minutes of February 19, 2010.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.

HF3130 (Lesch): Fire departments authorized to access criminal history data on current employees.

Rep. Lesch moved that HF3130 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Lesch presented HF3130 and took questions from the committee.

The following individuals testified in support of HF3130 and took questions from the committee:

Jerry Streich, Lino Lakes Fire Department
Dan Winkel, MN State Fire Dept. Association

Rep. Lesch renewed his motion that HF3130 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Chair Lesch resumed the gavel at 8:42 am.

HF2965 (Paymar): Gang and drug task forces certification process established, criminal gang investigative data systems creation authority established, certain entities dissolved, and forfeiture reporting requirements amended.

Rep. Paymar moved that HF2965 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Paymar moved to amend HF2965 (see H2965DE4).

Rep. Paymar offered an oral amendment to the H2965DE4 amendment as follows:

Page 2, line 28: strike "oversight" and insert "coordinating"
Page 5, line 31: after "299" insert "A"

Rep. Paymar incorporated the oral amendment changes into the H2965DE4 amendment.

Rep. Paymar renewed his motion to amend HF2965 (see H2965DE4).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Jim Nobles, Legislative Auditor, testified to HF2965 as amended, and took questions from the committee.

Rep. Paymar presented HF2965 as amended and took questions from the committee.

Rep. Paymar renewed his motion that HF2965, as amended, be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF3089 (Paymar): Statutory cap exception provided on bail for certain nonfelony domestic abuse offenders, domestic abuse no contact order law recodified and clarified, tampering with a witness crime expanded, and data communications network requirement clarified.

Rep. Paymar moved that HF3089 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Paymar presented HF3089 and took questions from the committee.

Shellene Johnson, MN Coalition for Battered Women, testified in support of HF3089 and took questions from the committee.

Rep. Paymar renewed his motion that HF3089 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF3090 (Hilstrom): Stalking crime modified.

Rep. Hilstrom moved that HF3090 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Hilstrom presented HF3090 and took questions from the committee.

Shellene Johnson, MN Coalition for Battered Women, testified in support of HF3090 and took questions from the committee.

Rep. Hilstrom renewed her motion that HF3090 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.
