MINUTES



Representative John Lesch, Chair of the Crime Victims & Criminal Records Division, started the eleventh meeting at 12:05 pm on Wednesday, March 10, 2010 in the Basement of the State Office Building. A quorum was present and the meeting was called to order.

The Committee Legislative Assistant noted the roll.

Agenda/ Action:

Chair Lesch called for a motion to approve the minutes of March 5, 2010.

Rep. Olin moved to approve the minutes of March 5, 2010.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.

HF3447 (Bigham): DNA collection from offenders authorized.

Rep. Hilstrom moved that HF3447 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Hilstrom presented HF3447 on behalf of Rep. Bigham.

David Brown, Hennepin County Attorney’s Office testified on behalf of HF3447 and took questions from the committee.

Rep. Hilstrom renewed her motion that HF3447 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF1396 (Paymar): Domestic abuse; courts authorized to include pets and companion animals in protective orders.

Rep. Paymar moved that HF1396 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Paymar moved to amend HF1396 (see H1396A1).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Paymar presented HF1396 as amended, and took questions from the committee.

Liz Richards, Minnesota Coalition of Battered Women, testified in support of HF1396 as amended, and took questions from the committee.

THE MOTION PREVAILED AND THE BILL WAS PASSED.

Vice-Chair Shimanski assumed the gavel at 12:36pm.

HF3382 (Lesch): Public hearings and public access to juvenile records governing provisions modified, expungement authorized of certain juvenile records, and human services commissioner authorized to grant set of asides or variances for certain individuals disqualified from licensure because of an offense as a juvenile.

Rep. Lesch moved that HF3382 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Lesch moved to amend HF3382 (see H3382A1).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Lesch presented HF3382 as amended and took questions from the committee.

Mark Haase, Council on Crime & Justice, testified on behalf of HF3382 as amended, and took questions from the committee.

Sandy Nerrin, MN Newspapers Association, testified on HF3382 as amended and took questions from the committee.

Rep. Lesch renewed his motion that HF3382 as amended be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Chair Lesch resumed the gavel at 12:42pm.

HF2960 (Paymar): Background check required for transfer of a firearm at a gun show and penalty provided.

Rep. Paymar moved that HF2960 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Paymar presented HF2960 and took questions from the committee.

Joan Peterson, Million Moms March; Citizens for a Safer Minnesota, testified in support of HF2960 and took questions from the committee.

John Caile, Gun Owners Alliance, testified in opposition to HF2960 and took questions from the committee.

Rep. Paymar renewed his motion that HF2960 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED.

Rep. Olin called for division. The results were:

5 NAYES
THE MOTION TO PASS HF2960 DID NOT PREVAIL.

The meeting was adjourned at 1:01 pm.
