Representative Benson, Vice-Chair of the Finance Committee, called the meeting to order at
9:19 A.M. on Friday, May 7, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Hausman moved approval of the minutes of Tuesday, May 4, 2010. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Vice-Chair Benson moved adoption of the K-12 Education Finance Division Report for HF2072. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Vice-Chair Benson moved that HF2072 be recommended to pass and placed on the General Register.

Rep. Ward presented HF2072 (Greiling) Education finance reference updated.

Vice-Chair Benson renewed the motion that HF2072 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Vice-Chair Benson moved that HF3699 be recommended to pass and placed on the General Register.

Vice-Chair Benson moved to amend HF3699. (See attached amendment H3699DE1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Vice-Chair Benson presented HF3699, as amended (Greiling) School district discretionary levy authorized.

Rep. Benson renewed the motion that HF3699, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Rep. Paymar moved adoption of the Public Safety Finance Division Report for HF3795. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Paymar moved that HF3795 be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Paymar moved to amend HF3795. (See attached amendment S3379A1).

Rep. Paymar moved to incorporate an oral amendment to Amendment S3379A1, as follows:

Page 1, line 1, delete "S.F. No. 3379" and insert "H.F. No. 3795"

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Rep. Eken and Rep. Lanning presented HF3795, as amended (Eken) FEMA Public Assistance Program money appropriated.

Kris Eide, Director, Minnesota Homeland Security and Emergency Management (HSEM), testified on HF3795, as amended.

Rep. Hausman moved to amend HF3795, as amended. (See attached amendment RA10-479) THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Carlson assumed chair at 9:56 A.M.

Rep. Nelson responded to questions regarding HF3795, as amended.

Kathy Novak, House Research, responded to questions regarding HF3795, as amended.

Rep. Paymar renewed the motion that HF3795, as amended, be recommended to pass and re-referred to the Committee on Ways and Means.

A division was requested on the motion. There were 9 Ayes and 6 Nays. THE MOTION PREVAILED.

Rep. Paymar moved adoption of the Public Safety Finance Division Report for HF3796. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Paymar moved that HF3796 be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Lanning presented HF3796 (Lanning) FEMA Public Assistance Program money appropriated.

Rep. Paymar moved to amend HF3796. (See attached amendment H3796A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Paymar renewed the motion that HF3796, as amended, be recommended to pass and re-referred to the Committee on Ways and Means.

A division was requested on the motion. There were 8 Ayes and 4 Nays. THE MOTION PREVAILED.

Chair Carlson moved adoption of the State Government Finance Division Report for HF 2227, First Engrossment, as amended. (Following are the two amendments adopted by the State Government Finance Division to HF2227, First Engrossment, on Friday, May 7, 2010).

Amendment 1:

Winkler moved to amend HF2227, the first engrossment, as follows:

Page 2, line 32, after "Administration" insert",one member of the majority caucus and one member of the largest minority caucus"
Page 3, line 2, after "house" insert",one member of the majority caucus and one member of the largest minority caucus"
Page 7, line 32, after "comments" insert "and requests to present oral comments"
Page 8, line 11, after the period insert "If a member of the public requests to present comments or information at the hearing, the council must permit the member of the public an opportunity to present the comments or information."



Amendment 2:

Winkler moved to amend HF2227, the first engrossment, as amended, as follows:

Page 15, line 27, delete "350,000" and insert "50,000"
Page 15, line 35, after "sources" and insert "This is a one-time appropriation"

THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Chair Carlson moved that HF2227, First Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Marquart presented HF2227, First Engrossment, as amended (Marquart) Board of Innovation reestablished, powers and duties imposed, and money appropriated.

Chair Carlson renewed the motion that HF2227, First Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Vice-Chair Benson resumed chair at 10:36 A.M.

Rep. Carlson moved that SF1679, First Engrossment be recommended to pass and be placed on the General Register.

Rep. Carlson moved to amend SF1679, First Engrossment. (See attached amendment S1679DE1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Carlson presented SF1679, First Engrossment, as amended (Carlson) Retirement incentives authorized.

Rep. Carlson renewed the motion that SF1679, First Engrossment, as amended, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

The following Finance Committee bills were referred by memo on May 6, 2010 and May 7, 2010.

As of Thursday, May 6, 2010, the Finance Committee refers HF2227 (Marquart) Minnesota Innovation and Research Council established, powers and duties council imposed, and money appropriated to the State Government Finance Division.

As of Friday, May 7, 2010 the Finance Committee recalls HF3699 (Greiling) School district discretionary levy authorized from the K-12 Education Finance Division.
