Representative Bob Gunther, Chair of the Jobs & Economic Opportunity Policy & Finance Committee, called the forty-fourth meeting to order at 8:28 a.m., on Thursday, April 21, 2005, in Room 10 of the State Office Building.

The Clerk noted the roll.

Chair Gunther brought HF1976, as amended, back before the committee for further discussion.


Representative Wilkin moved to adopt Amendment H1976A24. Motion prevailed. Amendment H1976A24 was adopted.


Representative Slawik moved to adopt Amendment H1976A23.

Representative Clark moved to adopt Amendment H1976A13.

Representative Clark requested to divide Amendment H1976A13 between page 4, line 18 and page 4, line 19.

Representative Clark moved to adopt Amendment H1976A13, page1, line 1, through page 4, line 18. The motion prevailed. Amendment H1976A13, page1, line 1, through page 4, line 18, was adopted.

Representative Clark requested to delete in Amendment H1976A13, page 5, line 31, through page 7, line 18.

Representative Clark withdrew the entire second half of Amendment H1976A13, page 4, line 19 to the end of the amendment, page 7, line 18.

Chair Gunther moved to adopt Amendment H1976A12. The motion prevailed. Amendment H1976A12 was adopted.

Chair Gunther requested to amend Amendment H1976A9, page 6, line 32, reinsert stricken language and delete "2005", insert "2006". Chair Gunther incorporated this change into his amendment.

Chair Gunther requested to amend Amendment H1976A9, page 3, lines 28 through 32, reinsert the stricken language and line 30, delete "one eighth" and insert "three eighths". Chair Gunther incorporated this change into his amendment.

Chair Gunther brought Amendment H1976A8 back before the committee.

Representative Mahoney moved Amendment A05-0736 to amend Amendment H1976A8.

Representative Mahoney moved to amend the amendment to Amendment H1976A8, page 1, line 12, delete "In addition to the 12 members above," and capitalize the "t" before "the governor". And on page 2, line 13, delete "October 31, 2005" and insert "January 15, 2006". Representative Mahoney incorporated this change into his amendment.

Chair Gunther moved to adopt Amendment H1976A28.

Chair Gunther requested to amend Amendment H1976, page 1, line 18, delete "telephone company," and insert "local exchange carrier or a"; page 1, line 19, delete "or independent telephone" and insert "as defined in Minnesota Rule chapter 7811,"; page 1, line 20, delete "company". Chair Gunther incorporated this change into his amendment.

Chair Gunther renewed his motion to adopt Amendment H1978A28, as amended. The motion prevailed. Amendment H1976A28, as amended was adopted.


Chair Gunther moved to adopt Amendment H1976A33. The motion prevailed. Amendment H1976A33 was adopted.


Representative Clark moved to adopt Amendment H1976A18-1.

Representative Clark requested to amend Amendment H1976A18-1, page 2, line 38 and 39, delete "June 30, 2008" and insert "December 31, 2007"; page 74, line 6, insert "the Commissioner of Finance shall transfer $380,000 from the workforce development fund to the General Fund on July 1, 2005." Representative Clark incorporated this change into her amendment.

Representative Clark renewed her motion to adopt Amendment H1976A18-1, as amended. The motion did not prevail. Representative Clark called for a division. The vote was 5 “yes” votes and 7 “no” votes.


Representative Slawik moved to adopt Amendment H1976A21-1. The motion did not prevail. Representative Slawik called for a division. The vote was 5 “yes” votes and 6 “no” votes.


Representative Sertich moved to adopt Amendment H1976A20-1. The motion did not prevail. Representative Sertich called for a division. The vote was 5 “yes” votes and 7 “no” votes.


Chair Gunther moved to adopt Amendment H1976A29.

Representative Clark moved to adopt Amendment A05-0675.

Representative Clark requested to amend Amendment A05-0675 with Amendment H1976A32. Representative Clark incorporated this change into Amendment A05-0675.

Representative Clark renewed her motion to adopt Amendment A05-0675, as amended. The motion prevailed. Amendment A05-0675, as amended was adopted.



Representative Bradley moved to adopt Amendment LA/HRD. The motion prevailed. Amendment LA/HRD was adopted.


Representative Clark moved to adopt Amendment JL34.

Representative Clark requested to amend Amendment JL34, page 1, line 1, after “H. F. No.” insert “1976”; page 1, line 2, after “Page” insert “87” and after “line” insert “3”; page 1, line 3, after “”Sec.” insert “9”. Representative Clark incorporated this change into her amendment.

Representative Sertich renewed his motion to adopt Amendment H1976A7. The motion prevailed. Amendment H1976A7 was adopted.


Representative Sertich moved to adopt Amendment H1976A16-1.

Representative Sertich requested to delete lines 3 through 8; lines 14 and 15, delete “June 30, 2008.” and insert “December 31, 2007.”; and divide the amendment between line 9 and line 10. Representative Sertich incorporated this change into his amendment.

Representative Sertich moved to adopt lines 1, 2 and 9. The motion did not prevail. Representative Sertich called for a division. The vote was 4 “yes” votes and 6 “no” votes.


Representative Sertich moved to adopt lines 10 through 18, the 2nd half of the H1976A16-1 amendment. The motion prevailed, Amendment H1976A16-1, lines 10 through 18, as amended, was adopted.


Representative Clark moved to adopt Amendment H1976A17-1. The motion did not prevail. Representative Clark called for a division. The vote was 4 “yes” votes and 7 “no” votes.


Representative Wilkin moved to reconsider the 2nd part, lines 10 through 18, of Amendment H1976A16-1.

Chair Gunther called a recess at 9:56 PM.
Chair Gunther reconvened the committee at 10:02 PM.

Representative Wilkin renewed his motion to reconsider the 2nd half, lines 10 through 18, of Amendment H1976A16-1.

Representative Sertich called for a roll call to reconsider the 2nd half, lines 10 through 18, of Amendment H1976A16-1. There were 7 “aye” votes (Gunther, Garofalo, Bradley, Gazelka, Ruth, Westerberg and Wilkin) and 5 “nay” votes (Clark, Mahoney, Nelson, Sertich and Slawik). The motion prevailed. The 2nd half the 2nd part, lines 10 through 18, of Amendment H1976A16-1 was reconsidered.

Representative Mahoney called for a roll call to vote on the 2nd half, lines 10 through 18, of Amendment H1976A16-1. There were 5 “aye” votes (Clark, Mahoney, Nelson, Sertich, and Slawik) and 7 “nay” votes (Gunther, Garofalo, Bradley, Gazelka, Ruth, Westerberg and Wilkin). The motion did not prevail. The 2nd half, lines 10 through 18, of Amendment H1976A16-1 was not adopted.


Chair Gunther moved to adopt Amendment H1976A31.

Chair Gunther withdrew Amendment H1976A31.


Chair Gunther moved to recommend passage of HF1976, as amended, and re-refer to the Committee on Ways & Means.

Representative Mahoney called for a roll call. There were 7 “aye” votes (Gunther, Garofalo, Bradley, Gazelka, Ruth, Westerberg and Wilkin) and 5 “nay” votes (Clark, Mahoney, Nelson, Sertich, and Slawik). The motion prevailed. HF1976, as amended, was recommended to pass and re-referred to the Committee on Ways & Means.




The meeting was adjourned at 10:47pm.
