I have vetoed and am returning to you H. F. No. 844, Chapter No. 72, a bill related to education finance.

As I have said before, the bill's total investment of $400 million is insufficient given the state's large surplus. In 2013, with a projected budget deficit of $627 million, the spending increase above the base for E-12 education was $606 million. It is astonishing that with a $1.9 billion surplus, and more than $1 billion left on the bottom for future

tax cuts, there would be less invested in our schools this year. And it is incomprehensible that estate tax cuts for millionaires and property tax relief for large corporations are higher priorities for your House Republican Caucus than investing adequately in our students and young children.

This bill omits the following funding, which I specified in my May 15th email to you and Senator Bakk (copy attached).

· No funding for eliminating the waiting list of 2500 low-income children for Head Start.

· No funding for the Northside Achievement Zone and St. Paul Promise Neighborhood.

· No funding for Bureau of Indian Education schools and only meager funding for American Indian students.

· No funding for Special Education.

· No funding for English Learning programs.

· No funding for free breakfasts for prekindergarten and first graders.

· No funding for Regional Centers which help our most struggling schools improve.

Also unacceptable is the absence of any version of voluntary, universal prekindergarten which will help 47,000 4-year olds, which has been my number one priority in this session. Despite my willingness to move from full-day to half-day prekindergarten, and despite my urging that we take a comprehensive approach to educating young children, your bill neglects the opportunity to make transformational changes for our 4-year olds.

Throughout this session, I have heard passionate rhetoric from your members about the urgent need to close the achievement gap. This bill belies that rhetoric, and instead chooses to shortchange our youngest students for future tax cuts.

Therefore, I am vetoing this bill.

I have vetoed and am returning H. F. No. 846, Chapter No. 79, a bill related to state government, appropriating money for agriculture, environment and natural resources.

The bill contains vitally important statutory changes and funding for the avian influenza outbreak and buffer zones. I am deeply disappointed that these provisions are part of a larger bill that undermines decades of environmental protections, including:

· Excessive raids of the Closed Landfill Investment Fund and the metropolitan landfill contingency action trust account, despite a budget surplus.

· Requiring a three-week notice before discretionary environmental reviews can be ordered.

· Preventing the Minnesota Pollution Control Agency (MPCA) from adopting water quality standards by requiring lengthy, expensive and unnecessary steps in the rulemaking process.

· Requiring 18-24 months of rulemaking before adopting basic policies and guidelines.

· Granting amnesty to regulated parties that self-report violations of environmental regulations.

· Delaying enforcement of updated nutrient pollution permits for wastewater treatment facilities in the Red River watershed until 2025, unless approved by the U.S. EPA, North Dakota Department Health, and EPA Regions 5 & 8.

· Earmarks within the Remediation Fund that prevent the MPCA from honoring its commitments to clean up Superfund sites in several communities throughout the state.

· Inadequate funding that limits the Environmental Quality Board's ability to streamline the environmental review process.

· Eliminating the Citizens' Board of the MPCA.

Minnesotans care deeply about our Great Outdoors, and expect that our regulatory agencies will have the authority needed to protect our natural resources. H.F. No. 846 weakens the state's authority and threatens our future generations' rights to clean water, land and air.

Therefore, I am vetoing this bill. I will insist the bill's language regarding buffer zones and avian influenza be included in the legislation emanating from the upcoming Special Session.

I have vetoed and am returning H.F. No.1437, Chapter No. 80, a bill relating to jobs and energy. The bill insufficiently funds the Department of Commerce, the Bureau of Mediation Services and Minnesota's Workers' Compensation Court of Appeals. Its Broadband Funding is seriously inadequate. Additionally, the bill falls short in funding programs to advance Minnesota's Olmstead Plan; and it contains changes to Minnesota's net metering laws that will disincentivize the use of wind and solar power.

The Department of Commerce's mission is to protect the public interest; advocate for Minnesota consumers; ensure a strong, competitive and fair marketplace; and strengthen our state's economic future. The bill omits adequate funding needed to achieve this mission, including:

· No funding for the Department's health care rate review staffing.

· No funding for the health care civil and criminal enforcement staffing.

· No funding for the state's costs related to State of North Dakota, et al vs. Beverly Heydinger, Commissioner and Chair of Minnesota Public Utilities Commission, et al.

· No funding for the Department to execute its responsibilities pursuant to Article 3, Sec. 21.

· No funding for the Department to execute its responsibilities pursuant to Article 3, Sec. 17.

· No funding for the Energy Reliability Administration.

· No funding for the Department to execute its responsibilities pursuant to Article 3, Sec. 22.

· No funding for the Guaranteed Energy Savings Program.

· Inadequate funding for the Department's Administrative Services Division.

· Inadequate funding for the Energy Regulation and Planning Division.

· Inadequate funding for the Securities Unit Funding.

· Inadequate funding for the Fraud Bureau.

I will insist that legislation emanating from the Special Session will provide the Department with the resources it needs to continue to serve Minnesota's consumers and businesses.

This bill also omits the necessary funding for the Bureau of Mediation Services (BMS) and the Public Employee Relations Board (PERB). BMS provides mediation and dispute resolution services that impact nearly every public employer and employee. BMS does not receive a 1.8 percent operating adjustment, like other executive branch agencies; nor did it receive funding to complete Phase II of its case management database redesign. Similarly, the lack of funding for PERB will make it impossible for this new entity to carry out its statutory responsibility to oversee and adjudicate unfair labor practice charges in Minnesota.

In addition to underfunding BMS, the bill also fails to provide a 1.8 percent operating adjustment to the Workers' Compensation Court of Appeals. The Workers' Compensation Court of Appeals is a statewide appellate court that provides workers and employers necessary access to fair and just resolutions to workers' compensation issues.

The Border-to-Border Broadband Development Grant Program was designed to be a competitive program administered by the Office of Broadband Development (OBD). In the current biennium, the OBD received $20 million to make its first investments in broadband infrastructure. The OBD received 40 applications and after a thorough evaluation process, selected seventeen projects, which fully committed the available funds. The bill's total funding for Broadband in the next biennium is barely half of that amount. Furthermore, the earmarking of $2 million for one specific broadband project undermines the program's competitive process and sets a dangerous precedent.

I was disappointed that this bill did not include more funding for the Department of Employment and Economic Development and the Minnesota Housing Finance Agency to carry out their responsibilities under Minnesota's Olmstead Plan. At a time when Minnesota is striving to ensure people with disabilities have more opportunities to live and work in integrated settings, this bill would result in cuts to the Extended Employment and Individual Placements and Supports programs. These programs help ensure that Minnesotans living with disabilities or mental illness have the support services they need to be successful at work.

I will insist that legislation emanating from the upcoming Special Session fund these and other important programs so we can serve more people with disabilities, not fewer of them.

For these reasons I am vetoing this bill.
