In obedience to the Proclamation of the Honorable Arne H. Carlson, Governor of the State of Minnesota, summoning the two Houses of the Legislature to meet in Special Session, the members of the House of Representatives assembled in the Chamber of the House of Representatives at the Capitol in Saint Paul on Tuesday, the nineteenth day of August 1997, at 10:30 a.m.

PROCLAMATION FOR SECOND SPECIAL SESSION 1997

Whereas, Article IV, Section 12 of the Constitution of the State of Minnesota provides that a special session of the Legislature may be called by the Governor on extraordinary occasions; and

Whereas, The Eightieth Legislature adjourned without enacting legislation to provide relief in response to the 1997 flood in Northwestern Minnesota; and

Whereas, The Eightieth Legislature adjourned without enacting legislation to resolve the issue of compensation adjustments for certain positions within the Executive, Legislative and Judicial branches of state government; and

Whereas, The time permitted by law for passage of such legislation during the 1997 Session for the Legislature has expired, and an extraordinary occasion is thereby created; and

Whereas, The people of Minnesota are best served by a prompt conclusion of legislative business, with a limited agenda and, to the extent possible, prior agreement on laws to be enacted;

Now Therefore, I, Arne H. Carlson, Governor of the State of Minnesota, do hereby summon you, members of the Legislature, to convene in Special Session on August 19, 1997, at 10:30 a.m. at the Capitol in Saint Paul, Minnesota.

In Witness Whereof, I have hereunto set my hand and caused the Great Seal of the State of Minnesota to be affixed at the State Capitol this thirteenth day of August in the year of our Lord one thousand nine hundred and ninety-seven, and of the State the one hundred thirty-ninth.

Pursuant to Minnesota Statutes 1996, Section 3.073, the Speaker declared the House of Representatives organized for the 1997 Second Special Session.

Winter moved that the Chief Clerk be and is hereby instructed to inform the Senate and the Governor by message that the House of Representatives is now duly organized pursuant to law for this Second Special Session. The motion prevailed.

"(d) A large employer must pay each tipped employee who works in a restaurant or food service establishment at a rate of at least $4.65 an hour and a small employer must pay each tipped employee at a rate of at least $4.40 an hour. If a tipped employee for a large employer does not report sufficient tips during the employer's pay period to equal the difference between the above stated hourly rate of pay and $7 an hour, then the employer must pay the tipped employee the current minimum wage for nontipped employees. If a tipped employee for a small employer does not report sufficient tips during the employer's pay period to equal the difference between the above stated hourly rate of pay and $6 an hour, then the employer must pay the tipped employee the current minimum wage rate for nontipped employees.

Sec. 2. [REPEALER.]

Minnesota Statutes 1996, section 177.24, subdivision 2, is repealed."

PROTEST AND DISSENT

Under the provisions of Article IV, Section 11 of the Minnesota Constitution, the undersigned members of the House enter this Protest and Dissent because we believe that an action of the body is injurious to the public interest. We ask that our reasons for this dissent be entered into the Journal of the House.

During the roll call vote by which Senate File No. 2 of the Second Special Session of 1997 was considered for final passage the voting board was held open for more than two hours. During a part of that time the voting system was locked and members were unable to change their votes. Rep. Ron Erhardt rose to address the Speaker, to ask about his inability to change his vote from aye to nay. He then left the building and was not present at the time the board was officially closed and the roll was counted. There was apparently a similar concern about the vote by Rep. Juhnke. A decision of the Speaker

was made to show Rep. Juhnke as not voting. The bill passed with 68 affirmative votes. Since it was the intention of Rep. Erhardt to change his vote and he was not allowed to do so, the bill should not have passed.
