2.17    Subd. 2. COVID-19 vaccine injury compensation account. A COVID-19 vaccine
2.18injury compensation account is created in the general fund in the state treasury. Money in
2.19the account does not cancel and is appropriated to the commissioner of health to compensate
2.20patients or the estates of patients under the program established in subdivision 3 for serious
2.21adverse reactions to COVID-19 vaccines.
2.22    Subd. 3. Compensation program. (a) The commissioner of health shall establish a
2.23program to compensate patients who experienced a serious adverse reaction to a COVID-19
2.24vaccine, or the estates of these patients. The commissioner shall establish an application
2.25process for patients and estates of patients seeking compensation, a deadline to apply for
2.26compensation, and a timeline for processing and making determinations on applications.
2.27The commissioner shall specify supporting documentation that applicants must submit to
2.28document that the serious adverse reaction occurred and was caused by a COVID-19 vaccine,
2.29and shall determine how to calculate compensation amounts for eligible applicants.
2.30(b) A patient seeking compensation under this program must apply for compensation in
2.31a time and manner specified by the commissioner, and must submit the application materials
2.32and supporting documentation required by the commissioner. A patient may appeal a
3.1determination of the commissioner under this program to the district court for the county
3.2in which the patient resides.
3.3(c) The commissioner shall post information on the compensation program on the
3.4department website and shall take other steps to provide information on the compensation
3.5program to health professionals and patients."
