1.3    "Sec. 21. [93.70] ENSURING TIMELY ENVIRONMENTAL REVIEW OF
1.4METALLIC MINING PROJECTS.
1.5    Subdivision 1. Definitions. (a) For purposes of this section, the terms defined in this
1.6subdivision have the meanings given.
1.7(b) "Commissioner" means the commissioner of natural resources.
1.8(c) "Covered mining project" means a proposed metallic mineral mining project or a
1.9modification to an existing metallic mining project for which an environmental assessment
1.10worksheet or an environmental impact statement must be or is being prepared according to
1.11chapter 116D.
1.12(d) "Submission date" means the date on which a project proposer of a covered mining
1.13project submits the completed data portion of an environmental assessment worksheet to
1.14the responsible governmental unit for environmental review under chapter 116D.
1.15    Subd. 2. Environmental review goals. To ensure an environmental review process that
1.16is both timely and environmentally responsible, the responsible governmental unit for a
1.17covered mining project must attempt to ensure that all environmental reviews, permits, and
1.18approvals, including those at the federal level to the extent practicable, are completed in
1.19accordance with the following timelines:
1.20(1) when an environmental assessment worksheet is prepared for a project for which an
1.21environmental impact statement is not required, the decision on the need for an environmental
1.22impact statement must be made no later than 18 months after the environmental assessment
1.23worksheet submission date; and
2.1(2) when an environmental impact statement is prepared for a project, the decision on
2.2the adequacy of the final environmental impact statement must be made no later than three
2.3years after the environmental assessment worksheet submission date.
2.4    Subd. 3. Report. If a responsible governmental unit fails to meet a goal set forth in
2.5subdivision 2, it must, within five days, report to the project proposer and to the chairs and
2.6ranking minority members of the legislative committees and divisions with jurisdiction over
2.7mining to explain the reason for the failure and must provide an estimate of the additional
2.8time that will be required to determine whether an environmental impact statement is required
2.9or whether the final environmental impact statement is adequate, as applicable."
