1.7    Subd. 3. Administration. (a) The commissioner shall establish a schedule of tiered
1.8per-child scholarship amounts based on the results of the rate survey conducted under section
1.9119B.02, subdivision 7, the cost of providing high-quality early care and learning to children
1.10in varying circumstances, a family's income, and geographic location. annually set a
1.11scholarship amount per child that is not less than whichever is greater:
1.12(1) the rate paid under section 119B.13, subdivision 1; or
1.13(2) the statewide average general education revenue per average daily membership.
1.14(b) Notwithstanding paragraph (a), a program that has a four-star rating under section
1.15124D.142 must receive, for each scholarship recipient who meets the criteria in subdivision
1.162a, paragraph (b) or (c), an amount not less than the cost to provide full-time care at the
1.1775th percentile of the most recent market rate survey under section 119B.02, subdivision 7
1.18The commissioner shall not differentiate the per-child scholarship amount based on program
1.19type or a program's rating status under section 124D.142, but may pay a 15 percent
1.20differential above the per-child scholarship amount when a program meets the applicable
1.21requirements in section 119B.13, subdivision 3a.
1.22(c) A four-star rated program that has children eligible for a scholarship enrolled in or
1.23on a waiting list for a program beginning in July, August, or September may notify the
2.1commissioner, in the form and manner prescribed by the commissioner, each year of the
2.2program's desire to enhance program services or to serve more children than current funding
2.3provides. The commissioner may designate a predetermined number of scholarship slots
2.4for that program and notify the program of that number. For fiscal year 2018 and later, the
2.5statewide amount of funding directly designated by the commissioner must not exceed the
2.6funding directly designated for fiscal year 2017. Beginning July 1, 2016, a school district
2.7or Head Start program qualifying under this paragraph may use its established registration
2.8process to enroll scholarship recipients and may verify a scholarship recipient's family
2.9income in the same manner as for other program participants.
2.10(d) A scholarship is awarded for a 12-month period. If the scholarship recipient has not
2.11been accepted and subsequently enrolled in a rated program within three months of the
2.12awarding of the scholarship, the scholarship cancels and the recipient must reapply in order
2.13to be eligible for another scholarship. An extension may be requested if a program is
2.14unavailable for the child within the three-month timeline. A child may not be awarded more
2.15than one scholarship in a 12-month period.
2.16(e) A child who receives a scholarship who has not completed development screening
2.17under sections 121A.16 to 121A.19 must complete that screening within 90 days of first
2.18attending an eligible program or within 90 days after the child's third birthday if awarded
2.19a scholarship under the age of three.
2.20(f) For fiscal year 2017 and later, a school district or Head Start program enrolling
2.21scholarship recipients under paragraph (c) may apply to the commissioner, in the form and
2.22manner prescribed by the commissioner, for direct payment of state aid. Upon receipt of
2.23the application, the commissioner must pay each program directly for each approved
2.24scholarship recipient enrolled under paragraph (c) according to the metered payment system
2.25or another schedule established by the commissioner."
