1.4 "Sec. .... Minnesota Statutes 2020, section 325E.21, subdivision 6, is amended to read:
1.5 Subd. 6.
Criminal penalty. (a) A scrap metal dealer, or the agent, employee, or
1.6representative of the dealer, who intentionally violates a provision of this section,
is guilty
1.7of a misdemeanor.
1.8(b) A person who possesses a catalytic converter, detached from a vehicle, is guilty
of
1.9a gross misdemeanor. A person who is found guilty of possessing 3 detached catalytic
1.10converters in a period of no more than five years is guilty of a felony.
1.11(c) Paragraph (b) does not apply if that person can demonstrate legitimate possession
1.12by acquiring documentation from a local law enforcement agency demonstrating the person's
1.13lawful ability to sell or transfer the catalytic converter.
1.14(d) Law enforcement agencies must develop a process and documentation to certify
1.15ownership of a catalytic converter by a person wishing to possess a catalytic converter
that
1.16has been separated from an automobile and must provide a proof of ownership document
1.17to persons found to be legitimate owners of catalytic converters at the request of
that person.
1.18EFFECTIVE DATE.This section is effective August 1, 2021, and applies to crimes
1.19committed on or after that date."
