1.6    "Sec. 2. Minnesota Statutes 2020, section 626.8459, is amended to read:
1.7626.8459 POST BOARD; COMPLIANCE REVIEWS REQUIRED.
1.8(a) Each year, the board shall conduct compliance reviews on all state and local law
1.9enforcement agencies. The compliance reviews must ensure that the agencies are complying
1.10with all requirements imposed on them by statute and rule. The board shall include in the
1.11reports to the legislature required in section 626.843, subdivision 4, detailed information
1.12on the compliance reviews conducted under this section. At a minimum, the reports must
1.13specify each requirement imposed by statute and rule on law enforcement agencies, the
1.14compliance rate of each agency, and the action taken by the board, if any, against an agency
1.15not in compliance.
1.16(b) The board must conduct a compliance review after any major public safety event,
1.17including each event that qualifies for reimbursement under section 299A.85.
1.18(c) The board may impose licensing sanctions and seek injunctive relief under section
1.19214.11 for an agency's failure to comply with a requirement imposed on it in statute or rule.

1.20    Sec. 3. [626.8476] PUBLIC ASSEMBLY RESPONSE; POLICIES REQUIRED.
1.21    Subdivision 1. Model policy required. By December 15, 2021, the board must develop
1.22a comprehensive model policy on responding to public assemblies. The policy must be
1.23based on best practices in public assembly response drawn from both domestic and
2.1international sources. In developing the policy, the board must consult with representatives
2.2of the Bureau of Criminal Apprehension, Minnesota Police Chiefs Association, Minnesota
2.3Sheriff's Association, Minnesota Police and Peace Officers Association, Minnesota County
2.4Attorneys Association, a nonprofit that organizes public assemblies, a nonprofit that provides
2.5legal services to defend the rights of those who participate in public assemblies, and other
2.6interested parties. The board must distribute the model policy to all chief law enforcement
2.7officers.
2.8    Subd. 2. Agency policies required. (a) By March 15, 2022, each chief law enforcement
2.9officer must establish and implement a written policy on public assembly response that is
2.10identical or substantially similar to the board's model policy described in subdivision 1. The
2.11policy shall include specific actions to be taken during a public assembly response.
2.12(b) The board must assist the chief law enforcement officer of each state and local law
2.13enforcement agency in developing and implementing policies under this subdivision.
2.14    Subd. 3. Available resources. If an agency, board, or local representative reviews or
2.15updates its policies on public assembly response, it may consider the advice and counsel of
2.16nonprofits that organize public assemblies.
2.17    Subd. 4. Compliance reviews authorized. The board has authority to inspect state and
2.18local law enforcement agency policies to ensure compliance with subdivision 2. The board
2.19may conduct this inspection based upon a complaint it receives about a particular agency
2.20or through a random selection process. The board must conduct a compliance review after
2.21any major public safety event, including each event that qualifies for reimbursement under
2.22section 299A.85. The board may impose licensing sanctions and seek injunctive relief under
2.23section 214.11 for an agency's failure to comply with subdivision 2."
