1.3Page 17, after line 28, and insert:

1.4    "Sec. 11. Minnesota Statutes 2018, section 626.8452, is amended to read:
1.5626.8452 DEADLY FORCE AND FIREARMS USE; INTERCESSION TRAINING;
1.6POLICIES AND INSTRUCTION REQUIRED.
1.7    Subdivision 1. Deadly force policy. By January 1, 1992, the head of every local and
1.8state law enforcement agency shall establish and enforce a written policy governing:
1.9(1) the use of force, including deadly force, as defined in section 609.066,;
1.10(2) conflict de-escalation; and
1.11(3) interceding when another peace officer is using unreasonable force, by peace officers
1.12and part-time peace officers employed by the agency.
1.13The policy must be consistent with the provisions of section 609.066, subdivision 2, and
1.14may not prohibit the use of deadly force under circumstances in which that force is justified
1.15under section 609.066, subdivision 2.
1.16    Subd. 2. Deadly force and firearms use; initial instruction. Beginning January 1,
1.171992, the head of every local and state law enforcement agency shall provide instruction
1.18on the use of force, deadly force, and the use of firearms, conflict de-escalation, and
1.19interceding when another peace officer is using excessive or unreasonable force to every
1.20peace officer and part-time peace officer newly appointed by or beginning employment
1.21with the agency. This instruction must occur before the agency head issues a firearm to the
1.22officer or otherwise authorizes the officer to carry a firearm in the course of employment.
1.23The instruction must be based on the agency's written policy required in subdivision 1 and
2.1on the instructional materials required by the board for peace officer and part-time peace
2.2officer licensure.
2.3    Subd. 3. Deadly force and firearms use; continuing instruction. Beginning January
2.41, 1992, the head of every local and state law enforcement agency shall provide the
2.5instruction described in subdivision 2 to every peace officer and part-time peace officer
2.6currently employed by the agency. This instruction must be provided at least once a year.
2.7    Subd. 4. Record keeping required. The head of every local and state law enforcement
2.8agency shall maintain written records of the agency's compliance with the requirements of
2.9subdivisions 2 and 3.
2.10    Subd. 5. Licensing sanctions; injunctive relief. The board may impose licensing
2.11sanctions and seek injunctive relief under section 214.11 for failure to comply with the
2.12requirements of this section."
2.13Renumber the sections in sequence and correct the internal references
2.14Amend the title accordingly
