MINUTES

Representative Hackbarth, Chair of the Mining and Outdoor Recreation Policy Committee, called the fifteenth meeting to order at 2:57 P.M. on Wednesday, March 11, 2015, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Hackbarth called the meeting to order at 2:57 P.M. A quorum was present.

Representative Dill moved to approve the minutes of March 4, 2015 and the Lands Subcommittee minutes of March 10, 2015. THE MOTION PREVAILED.

H.F.1186 Lueck, Exempting mining companies from electrical licensing; amending Minnesota Statutes 2014, section 326B.33, subdivision 21.

Representative Lueck moved that H.F.1186 be re-referred to the Committee on Job Growth and Energy Affordability Policy and Finance.

Representative Lueck presented an overview of H.F.1186.

Bill Heaney, Legislative Director for the IBEW Minnesota State Council, testified on H.F.1186.

Representative Lueck renewed the motion that H.F.1186 be re-referred to the Committee on Job Growth and Energy Affordability Policy and Finance. THE MOTION PREVAILED.

H.F.1329 McNamara, Invasive species provisions modified; temporary water surface use controls in construction areas provided; state park permit provisions modified; wake surfing regulated; life jacket requirements, fire training requirements, auxiliary forest provisions, forest bough account, recreational vehicle transfer requirements, and water use permit issuance authority modified; civil penalties provided; rulemaking required; and money appropriated.

Representative McNamara moved that H.F.1329 be re-referred to the Committee on Environment and Natural Resources Policy and Finance.

Representative McNamara moved the H1329DE1 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Bob Meier, Assistant Commissioner of the Minnesota Department of Natural Resources, presented an overview of H.F.1329.

Representative Hackbarth moved the H1329A3 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Raymond Bohn, Lobbyist for All Terrain Vehicle Association of Minnesota, and George Radke, President of the All Terrain Vehicle Association of Minnesota, presented an overview of the A15-0195 amendment and took questions from committee members.

Representative Hackbarth renewed the motion that the A15-0195 amendment pass with the following oral amendment: delete everything after line 2.32, except for line 3.12 and 3.13. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative McNamara renewed the motion that H.F.1329, as amended, be re-referred to Committee on Environment and Natural Resources Policy and Finance. THE MOTION PREVAILED.

H.F.1429 Dill, Cass, Pine, and Todd Counties; public and private sale of state land provided.

Representative Dill recommended that H.F.1429, as amended by the Lands Subcommittee, be re-referred to the Committee on Environment and Natural Resources Policy and Finance.

Representative Dill explained the Lands Subcommittee recommendations to H.F.1429, as amended.

Kathy Lewis, Assistant Director of Lands and Minerals for the Minnesota Department of Natural Resources, testified on H.F.1429.

Representative Dill moved the A15-0184 amendment.

Kathy Lewis, Assistant Director of Lands and Minerals for the Minnesota Department of Natural Resources, testified on the A15-0184 amendment.

Representative Dill renewed the motion to pass the A15-0184 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative McNamara moved the A15-0197 amendment.

Kathy Lewis, Assistant Director of Lands and Minerals for the Minnesota Department of Natural Resources, testified on the A15-0197 amendment.

Representative McNamara renewed the motion to pass the A15-0197 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Dill renewed the motion that H.F.1429 be re-referred to the Committee on Environment and Natural Resources Policy and Finance. THE MOTION PREVAILED.

Representative Hackbarth moved to recess at 4:06 PM.

H.F.1070 McNamara, Restricting use of body-gripping traps near public roads and trails; amending Minnesota Statutes 2014, section 97B.903.

Representative McNamara moved that H.F.1070 be laid over for possible inclusion in an omnibus bill.

Representative McNamara moved the H1070A1 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative McNamara renewed the motion for H.F.1070 to be laid over for possible inclusion in an omnibus bill. THE MOTION PREVAILED.

H.F.1406 Hackbarth, Citizen oversight committee expiration extended; federal law compliance provided; enforcement provisions and provisions to take, possess, and transport wild animals modified. Licenses provided, landowner's bill of rights modified, and criminal penalties provided.

Rep. Hackbarth moved that bill H.F.1406 be re-referred to the Committee on Government Operations and Elections Policy.

Stan Linnell, Minnesota Department of Natural Resources Water Safety Manager, testified on H.F.1406.

Representative Hackbarth moved an oral amendment to the H1406DE2 amendment: Section 17, Line 9.26 delete “to” and insert “in the North Zone and from 9:00 A.M. on the Saturday nearest October 30th in the South Zone. The seasons shall be open until”. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Hackbarth moved an oral amendment to strike Section 23 from H.F.1406. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.
