MINUTES

Representative Murphy, Chair of Committee on State Government Finance and Veterans Affairs, called the meeting to order at 12:30 February 13, 2013 in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present

Rebecca Otto, State Auditor and Matt Lindemann, Director of Budget, Finance, and Technology; presented an overview and reviewed the Governors budget recommendations for Office of State Auditor.

Committee members questioned Auditor Otto until Chair Murphy announced that time had expired and the Auditor would be invited again at a later meeting. HF 253 would also be rescheduled.

Nancy Stark, Executive Director and Paul Mandell, Senior Planner; presented an overview and review of Governor's budget recommendations for the Capitol Area Architectural and Planning Board (CAAPB).

HF5 (Atkins) Minnesota Insurance Marketplace established, powers and duties prescribed, right to not participate established, open meeting requirements and data practices procedures specified, and money appropriated. (Continued from February 11, 2013 meeting).

Chair Murphy summarized where we were in review of HF5.

Representative Atkins presented his bill.

Chair Murphy restated her motion that HF5 be recommended to pass and be re-referred to the Health and Human Services Finance committee.

Follow up questions from members on HF 5 continued and were answered by continued testifiers:

April Todd-Malmlov, Executive Director of the MN Health Insurance Exchange

Chair Murphy announced that written testimony on HF 5 was in each member's folders.

At 1:58 Chair Murphy announced committee would reconvene at 5:45 tonight, Wednesday, February 13, 2013 to continue with the agenda

The Committee reconvened at 5:58 PM.

Rep. Dettmer asked for additional overview of HF5. Representative Atkins accommodated.

April Todd-Malmlov and Barbara Juelich, Budget Director for MMB, responded to additional questions from members regarding the exchange.

Peter Brickwedde, MN Chamber of Commerce; answered questions regarding HF5.

Chair Murphy proceeded with amendments to HF5

Representative Newton moved H0005A104 amendment, an author's amendment to HF5.

Representative Dettmer requested a roll call vote on the motion.

Representative Benson moved to re-refer H0005A105 as amended back to civil law committee.

Representative Howe moved amendment H0005A95. Representative Howe moved an oral amendment to amend H0005A95 as follows:
Line 1.10, delete "twice"
Line 1.9; delete "money lost due to"
Line 1.10; delete "fraud, waste and abuse."
Line 1.9; after "any" insert "misuse of funds as identified in accordance with Minnesota Statute 3.975."

THE MOTION PREVAILED. THE H0005A95 AMENDMENT WAS ADOPTED AS MODIFIED.

Representative Leidiger moved amendment H0005A96 and offers and oral amendment. Page 9, after line 2 (e) "no governmental unit may participate in the marketplace as a health carrier." Oral Amendment was adopted. Representative Atkins opposes this amendment.

THE MOTION DOES NOT PREVAIL. THE H0005A96 AMENDMENT WAS NOT ADOPTED.

Representative Benson withdrew the amendment H0005A98.

Representative Howe offers to moved amendment H0005A99; he requests a roll call vote on the motion. Representative Atkins opposes the amendment.

Chair Murphy renewed the motion that HF5, as amended, be recommended to pass and re-referred to the committee on Health and Human Services Finance.
