MINUTES

Representative Holberg, Chair of the Ways and Means Committee, called the meeting to order at 8:01 P.M. on May 4, 2011, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Holberg officially called the meeting to order at 8:10 P.M. A quorum was present.

HF1613 (Gottwalt): Marriage recognized as only a union between one man and one woman, and constitutional amendment proposed.

Representative Holberg moved HF 1613 be recommended to pass and be re-referred to the Committee on Rules and Legislative Administration.

Representative Holberg renewed her motion that HF 1613 be recommended to pass and be re-referred to the Committee on Rules and Legislative Administration. THE MOTION PREVAILED.

Representative Holberg called a recess of the meeting at 8:31 P.M.

Representative Holberg re-convened the meeting at 8:33 P.M.

Representative Downey moved to approve the minutes from the committee meeting on May 2, 2011. THE MOTION PREVAILED.

HF1381 (Erickson): Prekindergarten through grade 12 education policy provided, including general education, education excellence, special programs, facilities and technology, early childhood education, and student transportation.

Representative Holberg moved HF 1381 be recommended to pass and be placed on the General Register.

Representative Holberg moved to orally amend the H1381A31 Amendment as follows:

Page 1, line 7, delete "59" and insert "64" and delete "26" and insert "18"

HF1097 (McNamara): Pesticide control modified, acquisition provided, peatland protection modified, fees and fee disposition modified, invasive species provisions modified, cash match requirements modified, state water trails and waysides modified, Mineral Coordinating Committee modified, citizen oversight committees provided, adopt-a-WMA program created, definitions modified, recreational vehicle operating provisions modified, dual registration of motorcycles provided, nonresident off-road vehicle state trail pass required, watercraft titling modified, special vehicle use on roadways modified, oxygenated gasoline requirements modified, Water Law modified, local ordinance requirements modified, waste management provisions modified, landfill cleanup program modified, environmental review requirements modified, disposition of fees provided, and money appropriated.

Representative McNamara moved HF 1097 be recommended to pass and be placed on the General Register.

Representative McNamara moved to orally amend HF 1097 as follows:

Delete Sections 98 and 99

Representative Rukavina moved the A11-0433 Amendment.

Representative Rukavina moved to orally amend the A11-0433 Amendment as follows:

Page 1, line 16, delete "1,200 to 2,600" and insert "1,800 but less than 2,600"

THE MOTION PREVAILED. THE ORAL AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Representative Rukavina moved the A11-0434 Amendment.

Representative McNamara moved to orally amend the A11-0434 Amendment as follows:

Page 1, delete lines 5-10
Page 1, line 12, delete "fee" and insert "fees" and delete "a lease described under paragraph (a)" and insert "an easement"

Representative Rukavina moved the A11-0434 Amendment, as amended. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative McNamara renewed his motion that HF 1097, as amended, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

HF1162 (Ward): Nonnative species provisions modified, permits to control or harvest aquatic plants requirements modified, and criminal and civil penalties provided.

Representative Abeler moved HF 1162 be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.
