MINUTES
Representative David Dill called the sixth meeting to order at 8:15 a.m. on January 20, 2011, in the Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present at 8:15 a.m.

Representative Torkelson moved that the minutes from the committee meeting on January 19, 2011 be adopted. Representative Hilty seconded the motion. THE MOTION PREVAILED.

H.F. 55 (Hackbarth) Stream easement acquisition provisions modified; state park, state forest, and land exchange provisions modified; state parks and state forests added to and deleted from; and public and private sales, conveyances, and exchanges of state land authorized.

Representative Hackbarth moved that H.F. 55 be recommended to pass and be re-referred to the Committee on Ways and Means.

Representative Hackbarth and Bob Meier, Department of Natural Resources presented H.F. 55.

Gary Botzek, Minnesota Environmental Partnership, testified against H.F. 55.

Representative Hackbarth renewed his recommendation that H.F. 55 be passed and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Representative Torkelson assumed the gavel at 8:30.

The committee heard stakeholder testimony on H.F.1. Testifying: Scott Strand, Minnesota Center for Environmental Advocacy, Gwen Myers, League of Women Voters, Thom Petersen, Farmers Union, Tom Osteraas and Gordon Gray, Excelsior Energy, Gary Botzek, Minnesota Environmental Partnership, Bobby King, Land Stewardship Project, Lou Aune, Marshall County Engineer, Brian Ketring, Roseau County Engineer, Kelly Bengston, Kittson County Engineer, Mike Flaagan, Pennington County Engineer.

Chair McNamara assumed the gavel at 9:08.

H.F. 1 (Fabian) Environmental permitting efficiency provided, and environmental review requirements modified.

Representative Fabian moved that H.F. 1 be recommended to pass and be re-referred to the Committee on Civil Law.

Representative Fabian moved the H0001A9 amendment.

Representative Fabian moved to orally amend the H0001A9 amendment as follows:

Page 2, line 13 after "a" insert "change, addition or extension to an existing disposal"

Page 2, line 14 after "Discharging" insert "additional or increased"

THE MOTION PREVAILED. The amendment to the amendment was adopted.

Representative Fabian moved H0001A9 amendment, as amended to HF1. THE MOTION PREVAILED.

Representative Fabian, Tony Kwilas, Chamber of Commerce and Gordon Lightfoot, Environmental Law Group, presented H.F. 1.

Representative Wagenius orally moved to delete Section 4 of H.F. 1 and asked for a roll call.
