MINUTES

Representative Hamilton, Chair of the Agriculture & Rural Development Policy & Finance Committee, called the meeting to order at 10:23 a.m. on May 4, 2011, in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representatives Bruce Anderson and Franson were excused.

A quorum was present.

Representative Vogel moved to approve the minutes of May 3, 2011. THE MOTION PREVAILED.

Representative Paul Anderson moved HF 1098 before the committee to be held over for possible inclusion in an Ag Policy bill.

Representative Paul Anderson moved the amendment H1098 DE 1. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Paul Anderson renewed the motion that HF 1098 as amended, be held over for inclusion in an Ag Policy bill.


Chair Hamilton moved HF 1611 before the committee.
Testifying on HF 1611 was:

Chair Hamilton moved amendment H1611 A4. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Morrow moved to temporarily suspend the rules so that amendments could be heard. THE MOTION PREVAILED.
Chair Hamilton moved amendment H1611 A3.
Testifying on the A3 amendment were:

Chair Hamilton moved to strike on page 5, lines 5.4 through line 5.7 in Section 34. THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Testifying on the A3 amendment were:
Matt Wohlman, Assistant Commissioner, Minnesota Department of Agriculture
Kate Paris, Agricultural Utilization Research Institute

Chair Hamilton moved to strike lines on page 6, 6.17 through line 6.34, Section 5. THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Chair Hamilton moved to strike on page 1, lines 1.2 through 1.8. THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Chair Hamilton moved to delete on page 8, line 8.9. THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Testifying on the amended amendment was:
Kirk Koudelka, Minnesota Pollution Control Agency

Chair Hamilton renewed the motion to pass amendment HF1611 A3 as amended. THE MOTION PREVAILED. THE AMENDED AMENDMENT WAS ADOPTED.

Chair Hamilton declared a 15 minutes recess.

Chair Hamilton resumed the committee meeting at 11:50 a.m.

Representative Morrow moved an oral amendment to HF 1611 as amended, on page 5, line 5.17 and on page 4, line 4.31 to strike the words "a penalty equal to." THE MOTION PREVAILED. THE ORAL AMENDMENT WAS ADOPTED.

Representative Hamilton moved an oral amendment to delete:
Pages 6, Sections 11, 12, 13 and 14
Page 7, Sections 15 and 16
Page 8, Sections 17, 18, and 19
Page 9, Sections 20, 21, 22, and 23
Page 10, Sections 24 and 25
Page 15, Section 31
Page 16, Section 32 and 33
Page 17, Section 34
Page 20, Sections 38 and 39
Page 23, Section 45, on line 23.10, to delete after "2010," the words: "sections 27.19, subdivisions 2 and 3; 27.20, 223.18" and insert "section"
and to delete on line 23.11 the words "231.035; 231.28;" to retain "232.24, subdivision 3" and to delete the words "232.25; and 236.09, are" and insert "is"

Chair Hamilton withdrew the deletion of Section 39, lines 20.27 through line 21.15.

Chair Hamilton renewed the oral amendment to HF 1611 as amended. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Hamilton renewed the motion to pass HF 1611 as amended and be sent to the General Register. THE MOTION PREVAILED.

The meeting was adjourned at 12:02 p.m.
