MINUTES

Representative Hamilton, Chair of the Agriculture & Rural Development Policy & Finance Committee, called the meeting to order at 10:17 a.m. on March 23, 2011, in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Eken moved to approve the minutes of March 22, 2011. THE MOTION PREVAILED.


Representative Eken moved to temporarily suspend the rules in order to hear amendments.
Chair Hamilton declared a 10 minute recess.

Representative Paul Anderson assumed the gavel at 10:38 a.m.

Representative Hamilton moved that HF 1039, as amended, be passed and be re-referred to Ways and Means Committee.

Representative Poppe moved amendment H1039 A3. Representative Poppe moved an oral amendment to the amendment by striking lines 1.4 through line 1.6. THE MOTION PREVAILED. THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.
Testifying on H1039 A3 was:
Jerry Schoenfeld, Minnesota Association of Ag Educators
Representative Poppe moved amendment H1039 A3 as amended. THE MOTION PREVAILED. THE AMENDED AMENDMENT WAS ADOPTED.

Representative Eken spoke to amendment H1039 A6. Representative Eken withdrew his amendment.

Representative Morrow moved the H1039 A5 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Hamilton moved an oral amendment to strike lines 9.18 through line 9.20.
Testifying on the oral amendment was:
Bruce Stockman, Agricultural Utilization Research Institute (AURI)
THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Hamilton moved amendment H1039 A2. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Hamilton moved an oral amendment to strike lines 10.20 through 10.23. Testifying on the oral amendment was:
Greg Buzicky, Director, Pesticide & Fertilizer Division, Minnesota Department of Agriculture
Representative Hamilton withdrew his amendment.

Representative Hamilton moved an oral amendment to strike Section 8 on page 10.
Testifying on the oral amendment was:

Representative Hamilton renewed his motion to delete Section 8 on page 10. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Testifying on HF 1039 as amended was:
Joel Carlson, Legal Research/ Government Affairs

Representative Hamilton renewed his motion to pass HF 1039 as amended and re-refer to Ways and Means Committee.

Representative Hansen requested a roll call vote.
Voting in favor were: Hamilton, Anderson, P, Eken, Anderson, B, Kiel, LeMieur, McElfatrick, Schomacker, Shimanski, Torkelson, and Vogel.
Voting against were: Falk, Hansen, Hosch, Kath, Morrow, Persell, and Poppe.
Excused were: Franson, Fritz, and Ward.
The vote was: 12 ayes, 7 nays. THE MOTION PREVAILED.


The meeting was adjourned at 11:27 a.m.
