MINUTES


Debra Hilstrom, Chair of the Public Safety Policy & Oversight Committee, called to order the twenty-third meeting of the House Public Safety Policy & Oversight Committee at 6:35 pm on Thursday, March 25, 2009 in 400 North of the of the State Office Building, a quorum was present.

The Committee Legislative Assistant noted the roll.

HF1460 (Johnson): Earned compliance credit program established for persons on supervised release.

Rep. Johnson moved that HF1460 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Johnson moved to amend HF1460 (see 09-1372).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Johnson moved to orally amend HF1460 as follows:
Page 2, line 4, strike "2010" and insert "2011"

HF2022 (Bigham): Registered housing included with services establishments in definition of health care facility for registration of predatory offenders.

Rep. Bigham moved that HF2022 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Bigham presented HF2022 and took questions from the committee.

Tim O’Malley, Superintendent, Bureau of Criminal Apprehension, testified on behalf of HF2022 and took questions from the committee.

Rep. Bigham renewed her motion that HF2022 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

HF1827 (Paymar): Judicial sanctions enforced, fines, fees, and surcharges included.

Rep. Paymar moved that HF1827 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

Rep. Paymar moved to amend HF1827 (see H1827A1).

Rep. Morrow presented HF1639 and took questions from the committee.

HF728 (Mullery): Animal fighting device or substance possession prohibited.

Rep. Mullery moved that HF728 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Roger Fellows, City Prosecutor for the city of Brooklyn Park, testified in opposition to HF1827 and took questions from the committee.

Rep. Paymar renewed his motion that HF1827 be recommended to pass as amended, and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

HF2045 (Winkler): Specialized emergency response teams provided to supplement resources responding to catastrophe.

Chair Hilstrom moved that HF2045 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Winkler presented HF2045 and took questions from the committee.

Rep. Winkler presented HF1554 and took questions from the committee.

Chair Hilstrom renewed her motion that HF1554 recommended to pass and be re-referred to the General Register.

HF2027 (Johnson): Probation officers and pretrial release agents authorized to conduct searches of persons on probation or pretrial release.

Rep. Johnson moved that HF2027 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Rep. Johnson moved to amend HF2027 (see H2027A1).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Johnson presented HF2027 as amended and took questions from the committee.

Rep. Kohls moved to orally amend HF2027, as amended, as follows:
Delete page 1, line 5 through page 1, line 7.
THE MOTION DID NOT PREVAIL, THE AMENDMENT WAS NOT ADOPTED.

HF2063 (Hilstrom): Commissioner of public safety required to present performance measures to the legislature.

Rep. Hilstrom moved that HF2063 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

Rep. Hilstrom presented HF2063 and took questions from the committee.

Mary Ellison, Minnesota Department of Public Safety, testified on HF2063 and took questions from the committee.

Rep. Hilstrom renewed her motion that HF2063 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF2065 (Hilstrom): Commissioner of corrections required to present performance measures to the legislature.

Rep. Hilstrom moved that HF2065 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

Rep. Hilstrom presented HF2065 and took questions from the committee.

Barbara Cox, Minnesota Department of Corrections, testified on HF2065 and took questions from the committee.

Rep. Hilstrom renewed her motion that HF2065 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

Chair Bigham called for a motion to adopt the minutes of March 24, 2009.

Rep. Lesch moved to adopt the minutes of March 24, 2009.

Chair Hilstrom assumed the gavel at 8:12pm.

Chair Hilstrom announced that the following bills had already been heard in committee, and that they came back with a fiscal note requiring that they be referred to finance:

HF1039 (Smith): Provisions clarified for an inmate convicted for assaulting a correctional officer to serve sentence consecutive to the sentence for which they are imprisoned.

Chair Hilstrom moved that HF10389 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF600 (Kalin): Controlled substance offense minimum fine disbursement authorized to juvenile substance abuse court programs.

Chair Hilstrom moved that HF600 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

The meeting was adjourned at 8:12 pm.
