Representative Carlos Mariani, Chair of the K-12 Education Policy & Oversight Committee, unofficially called the thirty-fifth meeting to order at 8:33 AM on Thursday, April 2, 2009 in the basement hearing room of the State Office Building.

The Committee Legislative Assistant noted the roll:

Chair Mariani officially called the meeting to order at 8:43 AM. A quorum was present.

Rep. McFarlane moved the minutes of April 1, 2009 be adopted. THE MOTION PREVAILED. THE MINUTES WERE ADOPTED.

HF 1198 (Davnie)—A bill for an act relating to education; providing for harassment, bullying, intimidation, and violence policies; amending Minnesota Statutes 2008, section 121A.03; repealing Minnesota Statutes 2008, section 121A.0695.
(Continued from April 1, 2009 meeting)

Rep. Davnie moved the H1198A1 amendment.

Rep. Davnie incorporated the following oral amendment into the H1198A1 amendment:

Page 1, Line 19, delete "and" and insert "or"

Rep. Davnie renewed his motion that the H1198A1 amendment, as incorporated, be adopted. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Downey moved to amend HF 1198, as amended, as follows:
(amending the amendment adopted H1198A1 document):

Page 1, Line 16, delete "based on characteristics such as actual or perceived"
Page 1, delete Lines 17-19
Page 1, Line 20, delete "characteristics." and insert "against any person for any reason."

Questions and discussion followed.

Rep. Downey renewed his motion that his oral amendment be adopted. THE MOTION DID NOT PREVAIL.

Rep. Demmer renewed his request for a roll call vote on the final bill.

Rep. Davnie renewed his motion that HF 1198, as amended, be recommended to pass and placed on the general register.
