MINUTES


Representative Carlos Mariani, Chair of the K-12 Education Policy & Oversight Committee, called the twenty-first meeting to order at 8:33 AM on Wednesday, March 4, 2009 in the basement hearing room of the State Office Building.

The Committee Legislative Assistant noted the roll:

HF935 (Slocum) - A bill for an act relating to education; modifying charter school provisions; amending Minnesota Statutes 2008, sections 124D.10; 124D.11, subdivision 9.

Chair Mariani moved the H0935A25 amendment.

Rep. Slocum explained the H0935A25 amendment.

Chair Mariani renewed his motion that H0935A25 amendment be adopted. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Faust moved the following oral amendment to the H0935DE5 amendment, as further amended by H0935A25 amendment, as follows:

Page 14, Line 7-24, reinstate stricken language and delete the new language

Ms. Katie Piehl, Director of Charter School Sponsorship, Volunteers of America testified to the oral amendment.

THE MOTION DID NOT PREVAIL.

A division was called. The committee legislative assistant took the count.

The results of the division were:
With 6 Ayes and 14 Nays, THE MOTION DID NOT PREVAIL.

Rep. Abeler moved the H0935A10 amendment.

Rep. Abeler incorporated the following oral amendment into the H0935A10 amendment:

"Page 1, Line 15, after "schools" insert "consistent with school performance report card information under section 120B.36"

Assistant Commissioner Morgan Brown, Minnesota Department of Education, testified to the H0935A10 amendment, as amended.

Rep. Abeler incorporated the following oral amendment into the H0935A10 amendment:

Page 1, Line 3, delete: "other charter schools and"
Page 1, Line 4, delete: "school districts" and insert "the department"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Abeler moved the H0935A11 amendment.

Rep. Abeler incorporated the following oral amendment into the H0935A11 amendment:

Page 1, delete Line 21
Page 1, delete Lines 24-27

Rep. Abeler moved to divide the H0935A11 amendment as follows:

Page 1, Lines 3-8 and Lines 12-15 and
Page 1, Line 1-2, 9-11, 16-20, 22-23

Assistant Commissioner Morgan Brown, Minnesota Department of Education, testified to the H0935A11 amendment, as amended.

Rep. Abeler withdrew the first part of the amendment.

Rep. Abeler presented the second part of the amendment.

Rep. Abeler moved to divide the H0935A11 amendment as follows:

Page 1, Line 22-23 and
Page 1, Line 9-11, and 16-20

Rep. Abeler moved that the first part of the divided amendment be adopted. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Abeler moved that the second part of the divided amendment be adopted. THE MOTION DID NOT PREVAIL.

Rep. Greiling moved the H0935A14 amendment.

Rep. Greiling incorporated the H0935A27 amendment into the H0935A14 amendment.

Rep. Greiling renewed her motion that the H0935A14 amendment be adopted. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Norton moved the H0935A19 amendment.


Assistant Commissioner Morgan Brown, Minnesota Department of Education, testified against the H0935A19 amendment.

Rep. Norton incorporated the following amendment into the H0935A19 amendment:

Page 1, Line 9, delete "applies" and insert "does not apply"
Page 1, Line 10, delete "after" and insert "before"

Questions and discussion followed.

Rep. Norton renewed her motion that H0935A19, as amendment, be adopted. THE MOTION DID NOT PREVAIL.

Rep. Obermueller moved the A09-0072 amendment.

Questions and discussion followed.

A roll call was requested. The committee legislative assistant took the roll.

Rep. Abeler renewed his motion that that HF935, as amended, be recommended to pass, and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division. THE MOTION PREVAILED.

The meeting was adjourned at 10:05 AM.
