MINUTES



Representative Sheldon Johnson, Chair of the Telecommunications Regulation and Infrastructure Division, called the fifth meeting to order at 8:32 A.M. on March 13, 2009, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Johnson called the meeting to order at 8:32 A.M. A quorum was present.


Representative Lillie moved adoption of the February 27, 2009 minutes.
THE MOTION PREVAILED.


Representative Johnson moved that HF854 be taken off of the table.
Representative Johnson moved approval of HF854 be recommended to pass and sent to the Commerce and Labor committee.


HF 854 (Lesch) Customer liability for unauthorized use of lost of stolen cellular phones limited.


Testimony was given by:
Bob Bass, President A.T. & T of Minnesota


Representative Johnson moved approval of amendment H0854A1.
The amendment was adopted.


Representative Johnson renewed his or her motion that HF854 to pass as amended and be re-referred to Commerce and Labor committee.
The motion prevailed.


Representative Johnson moved approval of HF1038 be recommended to pass and sent to the Commerce and Labor committee.


HF 1038 (Jackson) Public Utilities Commission authorized to order refunds of unlawful utility rate revenues.

Representative Hoppe moved an oral amendment
On the H1038A 2 amend as follows:

On line 1.2 after Page delete "2" and insert "1"
On line 1.2 delete "sections" and insert "section"
On line 1.2 after section delete "and 3"
On line 1.2 after section, insert " Page 2, delete section 3."
The amendment was adopted.



Representative Johnson moved approval of amendment H1038A2, as amended.
The amendment was adopted.


Representative Johnson renewed his motion that HF1038 be recommended to pass as amended and re-referred to Commerce and Labor committee.
The motion prevailed.


Representative Juhnke moved approval of HF1149 be recommended to pass and sent to the Commerce and Labor committee.


HF 1149 (Juhnke) Telecommunications promotion activities provisions modified.

Representative Juhnke moved approval of amendment H1149DE1.
The amendment was adopted.


Representative Juhnke renewed his motion that HF1149 be recommended to pass as amended and re-referred to Commerce and Labor committee.
The motion prevailed.
