Representative Gene Pelowski, Chair of the State & Local Government Operations, Reform, Technology and Elections Committee, called the meeting to order at 8:01 A.M. on Tuesday, April 7, 2009, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Poppe moved that the minutes of April 2, 2009, be approved. THE MOTION PREVAILED.

Chairman Pelowski moved that HF927, Second Engrossment, be recommended to pass and re-referred to the Committee on Finance.

Representative Mahoney presented HF927 (Mahoney), Second Engrossment, a bill for an act relating to labor and industry; modifying construction codes and licensing; requiring rulemaking; etc.

Chairman Pelowski renewed the motion that HF927, Second Engrossment, be recommended to pass and re-referred to the Committee on Finance. THE MOTION PREVAILED.

Chairman Pelowski moved that HF723 be recommended to pass and re-referred to the Committee on Finance.

Chairman Pelowski moved to amend HF723 (see attached S0191-DE4). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Murphy, M., presented HF723 (Murphy., M.), as amended, a bill for an act relating to retirement; extending filing deadlines; requiring written applications; amending disability benefit provisions; etc.

Voting to abstain: Anderson, P. and Poppe.

There were 6 ayes, 9 nays and 2 abstains, THE MOTION FAILED.

Chairman Pelowski renewed the motion that HF866, Second Engrossment, be recommended to pass and re-referred to the Committee on Finance.

Representative Buesgens requested a roll call vote on the motion.

Voting aye: Pelowski, Hilty, Kahn, Kalin, Marquart, Morrow, Nelson, Poppe, Sterner and Winkler.

Voting nay: Anderson, P., Buesgens, Emmer, Gottwalt, Kiffmeyer, Lanning and Sanders.

There were 10 ayes and 7 nays. THE MOTION PREVAILED.

Representative Nelson moved adoption of the Local Government Division report HF1278, First Committee Engrossment. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Chairman Pelowski moved that HF1278, First Committee Engrossment, be recommended to pass and placed on the General Register.

Representative Sterner presented HF1278 (Sterner), First Committee Engrossment, a bill for an act relating to counties; providing for appointment and consolidation of certain county offices, subject to notice, hearing, reverse referendum; etc.

Chairman Pelowski moved that HF222, as amended, be recommended to pass and placed on the General Register.

Chairman Pelowski moved to amend HF222, as amended, (see attached H0222DE1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Slawik presented HF222 (Slawik), as amended, a bill for an act relating to elections; allowing certain persons access to multiple unit residences for certain campaign and election purposes; etc.

Chairman Pelowski renewed the motion that HF222, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Chairman Pelowski moved that HF884, First Engrossment, be recommended to pass and re-referred to the Committee on Finance.

Chairman Pelowski moved to amend HF884, First Engrossment (see attached H0884DE1). THE MOTION PREVAILED.

Representative Thissen presented HF884 (Thissen), First Engrossment, as amended, a bill for an act relating to health; creating a medical supplies and equipment purchasing alliance; proposing coding for new law in Minnesota Statutes, chapter 16B.

Chairman Pelowski moved to amend HF884, First Engrossment, as amended, as follows:

Representative Thissen presented HF986 (Thissen), First Engrossment, a bill for an act relating to human services; amending county maintenance of effort provisions for mental health services; changing family services collaboratives; establishing the State-County Results, Accountability, and Service Delivery Redesign Act; requiring reports; etc.

Chairman Pelowski moved to amend HF986, First Engrossment (see attached amendment A09-0367).

Chairman Pelowski incorporated the following oral amendment to amendment A09-0367, as follows:

Page 2, line 18, delete "delivery" and insert "deliver"

Representative Nelson moved adoption of the Local Government Division report, SF740, First Committee Engrossment. THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Chairman Pelowski moved that SF740, First Committee Engrossment, be recommended to pass and placed on the General Register.

Representative Abeler presented SF740 (Abeler), First Committee Engrossment, a bill for an act relating to highways; authorizing use by the county of Anoka of a design-build process to award contract for construction of intersection of U.S. Highway 10 and County State-Aid Highway 83.
