CIVIL JUSTICE POLICY COMMITTEE MINUTES



Representative Mullery, Chair of the Committee, called the meeting to order at 8:34 A.M. on Wednesday, January 21, 2009, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF100 (Winkler): A bill for an act relating to claims against the state; clarifying provisions governing the I-35W bridge collapse survivor compensation process; specifying indemnification rights; limiting access to certain records of the special master panel and specifying testimonial privileges; clarifying prohibition on third-party subrogation or recovery claims; amending Minnesota Statutes 2008, sections 3.7393, subdivisions 3, 6, by adding a subdivision; 3.7394, subdivision 4.

Representative Hilstrom moved HF100 before the committee.

Representative Winkler presented his bill.

Representative Hilstrom moved to orally amend HF100 as follows:

Page 2, line 2.23, after "claims" insert "such"

THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS INCORPORATED.

Representative Hilstrom moved that HF100, as amended, be recommended to pass, and when so passed, be placed on the General Register. THE MOTION PREVAILED.

Representative Johnson assumed the chair at 8:45 a.m.

HF90 (Mullery): A bill for an act relating to civil law; providing a general exemption for certain property owned by a debtor; amending Minnesota Statutes 2008, section 550.37, by adding a subdivision.

Representative Mullery presented his bill, and moved that HF90 be recommended to pass and when so passed be re-referred to the Committee on Commerce and Labor.

HF8 (Simon): A bill for an act relating to state government; establishing the Minnesota False Claims Act; assessing penalties; proposing coding for new law as Minnesota Statutes , chapter 15C.

Representative Hilstrom moved HF8 before the committee and moved that HF8 be recommended to pass, and when so passed, be re-referred to the Committee on Commerce and Labor
