Representative Kahn, Chair of the Division, called the meeting to order at 9:41 A.M. on May 6, 2010 in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

SF 3134 (Kahn) - Omnibus state government operations policy bill

Chair Kahn moved that SF 3134 be recommended to pass and be re-referred to the Finance Committee.

Chair Kahn then moved the H3449DE2 amendment incorporating the following oral amendment:

Page 1, line 1, delete "H.F." and insert "S.F."
Page 1, line 1, delete "3449" and insert "3134"

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn then moved the H3449A30 amendment incorporating the following oral amendment:

Page 1, line 1, delete "H.F." and insert "S.F."
Page 1, line 1, delete "3449" and insert "3134"

Mark Shepard, House Research, gave a brief overview of the H3449A30 amendment.

Chair Kahn renewed her motion to adopt the H3449A30 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved the S3134A7 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.


Chair Kahn moved the S3134A8 amendment.

Michael Muilenburg, Legislative Director, Office of Enterprise Technology (OET), responded to member questions.

Chair Kahn renewed her motion to adopt the S3134A8 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Downey moved the A-KD1 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved an oral amendment to the H3449DE2 as follows:

Page 15, after line 29, insert "Section 27 [predesign] M.S. 16B.335, Subd. 3 does not apply to projects under Laws of Minnesota 2010, Chapter 189, Section 19, Subdivision 4."

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Simon moved the S3134A1 amendment.

Judge Susan Miles and Judge Kathleen Gearin, both from the Minnesota District Judges Association, testified against the amendment.

Attorney Greg Wersal testified in support of the amendment.

Dale Nathan, The Truth About Minnesota, testified against the amendment.

Business owner Don Mashak, also testified against the amendment.

Representative Simon renewed his motion to adopt the S3134A1 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Kiffmeyer moved the S3134A3 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Kiffmeyer moved the S3134A4 amendment incorporating the following oral amendment:

Page 1, line 5, after "unpaid" insert "Secretary of State trained"

Bert Black, Legal Advisor, Office of the Secretary of State, responded to member questions.

Representative Kiffmeyer renewed her motion to adopt the S3134A4 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved the A-PK2 amendment.

David Arbeit, Geospatial Information Office, testified in support of the amendment.

Chair Kahn renewed her motion to adopt the A-PK2 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Lead Republican Peppin moved the S3134A6 amendment.

Chair Kahn moved an oral amendment as follows:

Page 1, line 18, delete everything after "governor."
Page 1, delete lines 19 and 20


Lead Republican Peppin incorporated the Kahn oral amendment into her amendment and renewed her motion to adopt the S3134A6 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Kalin moved the A-JK1 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Lead Republican Peppin moved an oral amendment to the H3449DE2 amendment as follows:

Page 13, lines 28 and 30, after "benefit" insert "or costs"

THE MOTION PREVAILED AND THE ORAL AMENDMENT TO THE H3449DE2 WAS ADOPTED.

Lead Republican Peppin renewed her motion to adopt the S3134A4 amendment as amended. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

At 11:01 A.M. Chair Kahn recessed the meeting to the call of the Chair.



Chair Kahn reconvened the Committee on May 7, 2010 at 9:37 A.M.

HF 2227 (Marquart) Minnesota Innovation and Research Council established, powers and duties of council imposed, and money appropriated.

Vice-Chair Winkler moved that HF 2227 be recommended to pass and be re-referred to the Finance Committee with the following oral amendment incorporated:

Page 15, line 27, delete "350,000" and insert "50,000"
Page 15, line 35, after the period insert "This is a one-time appropriation."

Representative Marquart testified in support of HF 2227.

Vice-Chair Winkler moved the H2227A4 amendment incorporating the following oral amendment:

Page 1, lines 3 and 5, before "minority" insert "largest"

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Jim Rhodes, Department of Administration, testified in support of the bill.

Vice-Chair Winkler renewed his motion that HF 2227 be recommended to pass, as amended, and be re-referred to the Finance Committee. THE MOTION PREVAILED.

SF 3134 (Kahn) - Omnibus state government operations policy bill

Representative Mahoney testified in support of section 21 of the H3449DE2 amendment.

Representative Downey moved the A-KD2 amendment.

Commissioner Sheila Reger and Dave Fielding, Director of Plant Management, both from the Department of Administration testified in support of the amendment.

Eliot Seide, Executive Director, AFSCME Council 5, testified against the amendment.

Representative Downey incorporated the following oral amendment:




Page 1, at the end of the first paragraph, insert: "The bargaining unit currently conducting the work shall be allowed to propose on the RFP to cover the services performed."

Representative Downey renewed his motion to adopt the A-KD2 amendment. THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Chair Kahn moved the S3134A10 amendment and incorporated the following oral amendment:

Page 1, line 22, after "individuals" insert "or non-public data"

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn renewed her motion that SF 3134 be recommended to pass, as amended, and be re-referred to the Finance Committee. THE MOTION PREVAILED.

Representative Kath moved that the minutes of April 20, 2010 be adopted. THE MOTION PREVAILED.

The meeting was adjourned at 11:17 A.M.
