Representative Carlson, Chair of the Finance Committee, called the meeting to order at
8:02 A.M. on Friday, May 8, 2009, in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Rep. Wagenius moved adoption of the Environment and Natural Resources Finance Division Report for HF2049, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Wagenius moved that SF1012, Second Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Wagenius moved to delete the language from SF1012, Second Engrossment and insert the language from HF2049, First Committee Engrossment. THE MOTION PREVAILED.

Rep. Wagenius presented SF1012, Second Engrossment, as amended/HF2049, First Committee Engrossment (Wagenius) Environment and natural resources funding provided, and money appropriated.

Rep. Kahn moved to amend SF1012, Second Engrossment. (See attached amendment H2049A4).

Susan Thornton, Director, Legislative-Citizen Commission on Minnesota Resources (LCCMR) responded to questions regarding the proposed amendment.

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Wagenius renewed the motion that SF1012, Second Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Murphy, M. moved approval of the minutes of Thursday, May 7, 2009. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Huntley moved adoption of the Health Care and Human Services Finance Division Report for HF0984, First Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Huntley moved that HF0984, First Engrossment be recommended to pass and be placed on the General Register.

Rep. Huntley moved to amend HF0984, First Engrossment. (See attached amendment H0984A3). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Norton presented HF0984, First Engrossment, as amended (Norton) Medical assistance coverage of primary care health care providers performing primary caries prevention services as part of the child and teen checkup program authorized.

Rep. Huntley renewed the motion that HF0984, First Engrossment, as amended, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Rukavina moved thatSF0097, Fourth Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Rukavina moved to delete the language from SF0097, Fourth Engrossment and insert the language from HF0292, Third Engrossment. THE MOTION PREVAILED.

Rep. Rukavina moved to amend SF0097, Fourth Engrossment, as amended. (See attached amendment H0292A8).

Rep. Rukavina moved to incorporate an oral amendment to Amendment H0292A8.

Kathy Novak, House Research, explained the oral amendment to Amendment H0292A8, as follows:

Page 1, lines 6-7 after the word "fund" insert a period and delete the rest of sentence
Page 1, line 8, delete "$256,000" and insert "$436,000"
Page 1, line 9, delete "$48,000" and insert "$517,000"

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Rep. Rukavina presented HF0292, Third Engrossment/SF0097, Fourth Engrossment, as amended (Rukavina/Murphy, S.) Medical marijuana use provided, civil and criminal penalties provided, expiration date provided for medical use of marijuana provisions, and money appropriated.

Rep. Rukavina renewed the motion that SF0097, Fourth Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Emmer requested a roll call on the motion:

Voting Aye: Carlson, Benson, Buesgens, Champion, Clark, Garofalo, Hackbarth, Hausman, Hilty, Huntley, Juhnke, Kahn, Paymar, Rukavina, Simon, Solberg, Wagenius

Voting Nay: Emmer, Kiffmeyer, Knuth, Pelowski, Shimanski, Slawik

There were 17 Ayes and 6 Nays. THE MOTION PREVAILED.

The Finance Committee referred the following bills by memo on Thursday, May 7, 2009.

As of Thursday, May 7, 2009, the following bills are hereby referred to the Higher Education and Workforce Development Finance and Policy Division.

HF2374 (Olin) Student loan forgiveness program established for dentists to increase enrollment in the University of Minnesota School of Dentistry, and money appropriated.

As of Thursday, May 7, 2009, the following bills are hereby referred to the Higher Education and Workforce Development Finance and Policy Division.

As of Thursday, May 7, 2009, the following bills are hereby referred to the Housing Policy and Finance and Public Health Finance Division.

HF2279 (Davnie) Home values guarantee pilot program established, five-year guarantee against depreciation in value of certain properties provided, incentives to restructure mortgage loans provided, and money appropriated.
HF2341 (Davnie) Tax credit loan program provided, and first-time homebuyer tax credit advance loan account established.
