Representative Loren Solberg, Chair of the Committee on Ways and Means, called the meeting to order at 10:00 AM, on Monday, May 3, 2010 in the Basement Hearing Room of the State Office Bldg.

The Committee Legislative Assistant noted the roll.

Representative Scalze moved adoption of the Minutes dated April 27, 2010 as presented.

Budget Resolution
Representative Solberg moved to amend the Budget Resolution as follows: see House budget Resolution adopted 4/17/10 and RES08-1.
Bill Marx, Fiscal Analyst explained the Budget Resolution, as amended.
Representative Solberg renewed his motion that the Budget Resolution, as amended be adopted.
THE MOTION PREVAILED

HF2614 (Huntley) Intensive care management program established for medical assistance enrollees, funding reduced for the medical assistance program, request for proposals required, report required, and money appropriated.

Representative Huntley moved that HF2614 be recommended to pass and placed on the General Register.

Representative Huntley presented HF2614.

Representative Huntley moved to amend HF2614 as follows: H2614A73.

John Walz, House Fiscal Analyst presented amendment H2614A73.

Representative Holberg moved to amend the amendment H2614A73 as follows: Page 12, delete Section 12, lines 12.5 thru 12.20
THE MOTION PREVAILED THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.


Representative Solberg moved to amend HF2614, as amended, as follows: see H2614A88.
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Representative Huntley renewed his motion that HF2614, as amended, pass and be placed on the General Register.

HF3281 (Murphy) Volunteer fire relief associations technical corrections made, break-in-service return revised, Minnesota deferred compensation plan service pension transfers authorized, payout defaults revised in survivor benefits, and corrections of certain special fund deposits authorized.

Representative Solberg moved that HF3281 be recommended to pass and placed on the General Register.

Representative Kahn moved to amend HF3281 as follows: See H3281-15A.

Larry Martin, Pension Committee testified on behalf H3281-15A.

Rep. Kahn renewed her motion to amend HF3281 with H3281-15A.
THE MOTION PREVAILED THE AMENDMENT IS ADOPTED

Rep Nelson moved to amend HF3281 as amended as follows: H3281-14A.

Representative Thissen testified on behalf HF3281-14A.

Representative Solberg renewed his motion that HF3281, as amended pass and be placed on the General Register.

HF3660 (Koenen) Department of corrections; settlement provided for certain claims against the state for injuries suffered.

Representative Solberg moved that HF3660 be recommended to pass and be placed on the General Register.

Craig Lindeke, House Research testified on behalf HF3660.

Representative Solberg renewed his motion that HF3660 pass and be placed on the General Register.

HF3571 (Koenen) publicly owned nursing facilities rate increase authorized, and local share required for nonfederal medical assistance costs.

Representative Solberg moved that HF3571 be recommended to pass and placed on the General Register

Representative Koenen presented HF3571.

Rep. Solberg renewed his motion that HF3571 pass and placed on the General Register.
THE MOTION PREVAILED

SF2505 (Slawik) Statewide child care provider training, coaching, consultation, and supports funding provided to prepare for the voluntary Minnesota quality rating system, and money appropriated.

Representative Solberg moved that SF2505 be recommended to pass and placed on the General Register.

Representative Solberg moved to amend SF2505 as follows: Page 10, delete 10.4 thru 10.12
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Representative Solberg renewed his motion that SF2505, as amended pass and be placed on the General Register.

SF3275/HF3702 (Wagenius) Omnibus environment and natural resources finance bill.

Representative Faust moved that SF3275 be recommended to pass and placed on the General Register.

Representative Faust moved that SF3275 be amended as follows: Delete all language in SF3275 and insert the language of HF3720.

THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Representative Solberg moved to amend SF3275, as amended as follows: see H3702A26.
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Representative Wagenius explained SF3275 as amended.

Jodi Boyne, Public Affairs Director, MPCA answered questions regarding SF3275 as amended.

Representative Hamilton moved that SF32785, as amended be re-referred to the Committee on Finance.
A roll call vote was requested. The Clerk took the roll.
Members voting AYE: Davids, Dean, Demmer, Hamilton, Holberg, Westrom.
Members voting NAY: Solberg, Brynaert, Bunn, Carlson, Faust, Hilstrom, Huntley, Kahn, Lenczewski, Nelson, Scalze, Swails.
Members Abstaining: McNamara, Otremba
There being 6 AYES and 12 NAYS:
THE MOTION DID NOT PREVAIL THE AMENDMENT WAS NOT ADOPTED.

Representative Westrom moves to amend SF3275, as amended as follows: delete section 72.

A roll call vote was requested. The Clerk noted the roll.
Members voting AYE: Bunn, Davids, Dean, Demmer, Hamilton, Holberg, McNamara, Westrom.
Members voting NAY: Solberg, Brynaert, Carlson, Faust, Hilstrom, Huntley, Kahn, Nelson, Rudd, Scalze, Swails.
Members passed: Otremba
There being 8 AYES, and 11 NAYS:
THE MOTION DID NOT PREVAILED THE AMENDMENT WAS NOT ADOPTED

Representative Solberg renewed his motion that SF3275 as amended pass and placed on the General Register
