MINUTES


Representative Cy Thao, Chair of the Committee, called the meeting to order at 6:30 P.M. on Wednesday, March 14, 2007, in Room 300S of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Norton moved that the minutes of March 12, 2007 be adopted. THE MOTION PREVAILED.

Chair Thao moved that SF26 be recommended to pass and re-referred to the Health and Human Services Committee.

SF26 (Thissen) Board of Medical Practices' advisory councils expiration dates extended

Chair Thao moved the S0026DE1 amendment. THE AMENDMENT WAS ADOPTED.

Chair Thao moved the S0026A1 amendment. THE AMENDMENT WAS ADOPTED.

Chair Thao announced a recess at 6:40 P.M.

Rep. Abeler moved to amend SF26, the DE1 amendment with 07-3334 as follows:

1.7 Section 36. Minnesota Statutes 2006, section 148B.53, subdivision 3, is amended to read:
1.8 Subd. 3. Fee. Nonrefundable fees are as follows:
1.9(1) initial license application fee for licensed professional counseling (LPC) - $250
1.10$150;
1.11(2) initial license fee for LPC - $250;
1.12(3) annual active license renewal fee for LPC - $200 $250 or equivalent;

1.13(3) (4) annual inactive license renewal fee for LPC - $100 $125;
1.14(4) (5) initial license application fee for licensed professional clinical counseling
1.15(LPCC) - $150;

1.17(7) annual active license renewal fee for LPCC - $250 or equivalent;
1.18(8) annual inactive license renewal fee for LPCC - $125;
1.19(9) license renewal late fee - $100 per month or portion thereof;
1.20(5) (10) copy of board order or stipulation - $10;
1.21(6) (11) certificate of good standing or license verification - $10 $25;
1.22(7) (12) duplicate certificate fee - $10 $25;
1.23(8) (13) professional firm renewal fee - $25;
1.24(9) (14) sponsor application for approval of a continuing education course - $60;

2.3 Sec. 37. Minnesota Statutes 2006, section 148C.12, is amended by adding a subdivision
2.4to read:
2.5 Subd. 12. Sponsor application fee. The fee for sponsor application for approval
2.6of a continuing education course is $60.

2.7 Sec. 38. Minnesota Statutes 2006, section 148C.12, is amended by adding a subdivision
2.8to read:
2.9 Subd. 13. Order or stipulation fee. The fee for a copy of a board order or
2.10stipulation is $10.

2.11 Sec. 39. Minnesota Statutes 2006, section 148C.12, is amended by adding a subdivision
2.12to read:
2.13 Subd. 14. Duplicate certificate fee. The fee for a duplicate certificate is $25.

2.14 Sec. 40. Minnesota Statutes 2006, section 148C.12, is amended by adding a subdivision
2.15to read:
2.16 Subd. 15. Supervisor application processing fee. The fee for licensure supervisor
2.17application processing is $30.

Chair Thao moved toamend SF26, the DE1 amendment as follows:

5.3 Sec. 2. [148B.532] DEGREES FROM FOREIGN INSTITUTIONS.
5.4 Subdivision 1. Scope and documentation. In addition to meeting all other licensure
5.5requirements, an applicant for licensure whose degree was received from a foreign degree
5.6program that is not recognized by the Council for Accreditation of Counseling and Related
5.7Education Programs (CACREP) or from a foreign institution of higher education that is
5.8not accredited by a regional accrediting organization recognized by the Council for Higher
5.9Education Accreditation (CHEA) must fulfill the requirements of this section, providing
5.10certified English translations of board-required relevant documentation.
5.11 Subd. 2. Education evaluation. An applicant for licensure as a licensed
5.12professional counselor must present evidence of completion of a degree equivalent to
5.13that required in section 148B.53, subdivision 1, paragraph (a), clause (3), and paragraph
5.14(b). An applicant for licensure as licensed professional clinical counselor must present
5.15evidence of completion of a degree equivalent to that required in section 148B.5301,
5.16subdivision 1, clause (3). This evidence will be evaluated by the board with the assistance
5.17of a credentials evaluation service familiar with educational standards and professional
5.18qualification. The evaluation must be sent directly to the board from the evaluating
5.19agency. Agencies providing evaluation services must be accepted by the National Board
5.20for Certified Counselors, Inc. The applicant shall be responsible for the expenses incurred
5.21as a result of the evaluation.
