MINUTES


Representative Gene Pelowski, Chair of the Governmental Operations, Reform, Technology and Elections Committee, called the meeting to order at 8:00 A.M. on Tuesday, March 20, 2007, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Morgan moved that the minutes of March 13, March 14, and March 15,
2007, be adopted. THE MOTION PREVAILED.

Scheduled for hearing: H. F. 571 (Hilstrom) First Engrossment

A bill for an act relating to state government; defining best value; changing provisions for acquisition and competitive bidding, etc.

Chairman Pelowski moved that HF 571 First Engrossment, be recommended to pass and re-referred to the Committee on Finance.

A bill for an act relating to health; establishing the Early Hearing Detection and Intervention Act; etc.

Chairman Pelowski moved that HF 1206 First Engrossment, be recommended to pass and re-referred to the Committee on Finance.

A handout was distributed to members of the committee on the Minnesota Newborn Screening Program.

Chairman Pelowski renewed his motion that HF 1206 First Engrossment be recommended to pass and re-referred to the Committee on Finance. THE MOTION PREVAILED.

A bill for an act relating to state government; requiring state agencies to certify that no state employees on recall lists are able to perform specified services before seeking approval of certain contracts; etc.

Representative Simon moved that HF 548 be recommended to pass and placed on the General Register.

Representative Simon moved to amend HF 548 (see attached H0548DE1 amendment).
THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Brod moved to amend HF 548, as amended, as follows:

Page 2, line 10, after the period, insert:

"The agency may make a decision based on best value."

Representative Brod requested a roll call vote on the motion.

Those voting aye: Anderson, S., Brod, Emmer, Peterson, N.

Those voting nay: Pelowski, Hilty, Howes, Kahn, Kalin, Morgan, Nelson, Poppe, Simon, Winkler and Wollschlager.

Absent: Olson

There were 4 ayes, and 11 nays, THE MOTION FAILED. THE AMENDMENT WAS NOT ADOPTED.

Representative Simon renewed his motion that HF 548, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

A bill for an act relating to state government; prohibiting contracts under competitive bidding process for certain offenses; etc.

Representative Emmer moved that HF 729 be recommended to pass and re-referred to the Committee on Finance.

Page 2, after line 26, insert:

"Subd. 4. (Repealer.) This section is repealed June 30, 2009."

Representative Winkler moved to amend HF 729, as amended, as follows:

Page 1, line 11, after "entity" insert ", including officers, directors, or
beneficial owners"

Page 2, line 1, after the second "applicant" insert ", including its officers,
directors, or beneficial owners"

Page 2, line 15, after "entity" insert ", including officers, directors, or
beneficial owners"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Emmer renewed his motion that HF 729, as amended, be recommended to pass and re-referred to the Committee on Finance. THE MOTION PREVAILED.

A bill for an act relating to the Office of the Secretary of State regulating registrations, filings, and dissolutions of certain entities; etc.

Chairman Pelowski moved that HF 1608 be recommended to pass and re-referred to the Committee on Finance.

Chairman Pelowski moved to amend HF 1608, as follows:

Article I, delete Sections 3 and 5
