Representative Erhardt, Vice Chair of the Committee, called the meeting to order at 8:18 A.M. on, March 23, 2007, in Room 10 of the State Office Building. The Committee Legislative Assistant noted the roll.

Rep. Beard moved that the minutes of March 15, 2007 be adopted. THE MOTIONPREVAILED. Rep. Madore moved that the minutes of March 16, 2007 be adopted. THE MOTION PREVAILED.

Rep. Hornstein moved consideration of HF 1351. Rep. Hornstein moved adoption of the H1351DE2 amendment. THE AMENDMENT WAS ADOPTED. Rep. Hornstein moved that HF 1049 (Liebling) be adopted as an amendment to HF 1351, the delete everything amendment (H1351DE2). THE AMENDMENT WAS ADOPTED. Charles Kenow, Office of Pipeline Safety spoke to the amendment. Rep. Hornstein moved that HF 1756 (Hortman) be adopted as an amendment to HF 1351 the delete everything amendment (H1351DE2). THE AMENDMENT WAS ADOPTED. Larry Ollila, Department of Public Safety (DPS), Minnesota Department of Transportation (MnDOT) spoke to the amendment. Rep. Hornstein moved that HF 2191 (Madore) be adopted as an amendment to HF 1351, the delete everything amendment (H1351DE2). THE AMENDMENT WAS ADOPTED. Beth Frazier, Secretary of State's Office and Pat McCormack, Department of Vehicle Services, DPS, MnDOT spoke to the amendment. Rep. Hornstein moved that HF 1821 (Hortman) be adopted as an amendment to HF 1351, the delete everything amendment (H1351DE2). THE AMENDMENT WAS ADOPTED. Larry Ollila, Department of Public Safety (DPS), Minnesota Department of Transportation (MnDOT) spoke to the amendment. Rep. Madore offered SC51986A-1 as an amendment. The amendment failed. Rep. Morrow offered A07-0543 as an amendment. Rep. Morrow withdrew A07-0543. Rep. Hornstein moved the HF1351A6 amendment. Rep. Horstein withdrew HF1351A6. Rep. Hornstein moved that HF 1821 (Hortman) be adopted as an amendment to HF 1351, the delete everything amendment (H1351DE2). THE AMENDMENT WAS ADOPTED. Rep. Hornstein moved that HF 1611 1st Engrossment (Hornstein) be adopted as an amendment to HF 1351, the delete everything amendment (H1351DE2). THE AMENDMENT WAS ADOPTED. Rep Holberg moved to verbally amend HF 1351 the delete everything amendment (H1351DE2) as follows:

Page 3, line 8, delete "of at least four hours" and insert "as required under code of federal regulations, title 49, part 172 (h), subpart (i),"

THE AMENDMENT WAS ADOPTED. Rep. Hornstein moved the H1351A7 amendment. John Apitz, Messerli & Kramer; Amber Backus, Pacific Railway; Phil Qualey, UTU and David Brown, Brotherhood of Locomotive Engineers and Trainmen spoke to the amendment. THE AMENDMENT WAS ADOPTED. Rep. Hornstein moved the H1351A12 amendment. Steve Frank, President & CEO of AAA Minneapolis spoke to the amendment. The amendment failed. Rep. Hornstein moved the H1351A8 amendment. Joel Ulland, Vice President of Public Affairs, National Multiple Sclerosis Society and Betsy Parker, MnDOT spoke to the amendment. THE AMENDMENT WAS ADOPTED. Rep. Hornstein moved that HF 735 (Lieder) be adopted as an amendment to HF 1351, the delete everything amendment (H1351DE2). THE AMENDMENT WAS ADOPTED. Rep. Hornstein moved the H1351A11 amendment. Eric Rudeen, MnDOT spoke to the amendment. THE AMENDMENT WAS ADOPTED. Rep. Hortman moved the 07-2289 amendment. Carol Lovro, Association of Minnesota Counties; Jerry Schonfeld, MN Soy Bean Growers and MN Pork Producers; and Betsy Parker, MnDOT spoke to the amendment. The amendment failed (in a show of hands-5 in favor and 11 opposed). Rep. Hornstein moved to verbally amend HF 1351, the delete everything amendment (H1351DE2) as follows:

Page 4, line 13, delete "direct" Page 5, line 15, delete "the day following final enactment" and insert "August 1, 2007". THE AMENDMENT WAS ADOPTED.

Rep. Morrow moved to verbally amend HF 1351, the delete everything amendment (H1351DE2), as follows:

Page 24, line 26, delete "act" and insert "article"

THE AMENDMENT WAS ADOPTED. Rep Hortman moved to verbally amend HF 1351, the delete everything amendment (H1351DE2), as follows:

Page 11, lines 31 to 32 delete the new language
Page 12, Lines 4 to 5, delete the new language
Page 12, line 21, delete "and"
Page 12, line 22, strike the period and insert "; and"
Page 12, after line 23, insert "(16) accomplish these goals with minimal impact on the environment."
Page 12, line 31, delete "prevent" and insert "minimize"
Page 14, delete sections 23 to 24

THE AMENDMENT WAS ADOPTED.

Rep. Kalin moved to verbally amend HF 1351, the delete everything amendment (H1351DE2) as follows:

Page 21, line 4, delete "transfers" and insert "surrenders"
Page 21, line 6, delete "transfer" and insert "surrender"

THE AMENDMENT WAS ADOPTED.

Rep. Severson moved to verbally amend HF 1351, the delete everything amendment (H1351DE2) as follows:

Page 19, delete section 1
Page 20, delete section 3
Page 21, delete sections 4 to 5
Page 22, delete sections 6 to 8
Page 23, delete sections 9 to 10
Page 24, delete sections 14

THE AMENDMENT WAS ADOPTED.

Rep. Hornstein moved the H1351DE1 amendment with handwritten changes (see attached). THE AMENDMENT WAS ADOPTED.

Rep. Hornstein moved that HF 1351, the delete everything amendment (H1351DE2) as amended be passed and referred to the House Finance committee. THE MOTION PREVAILED.
