The fifty-fourth meeting of the Health Care and Human Services Finance Division was chaired by Co-chair Larry Hosch on March 25, 2008 and was called to order at 3:19 p.m. in Room 200 of the State Office Building. A quorum was present. The clerk noted the roll:

Representative Thissen moved approval of the March 17, 2008 minutes. The motion prevailed.

HF 3976 (Huntley) - Representative Huntley moved HF 3976 be recommended to pass and returned to the Committee on Finance and further moved the H3976DE2 amendment. The motion prevailed.

Rep. Huntley moved adoption of the H3976A12 amendment. The motion prevailed.

Rep. Huntley explained the change items on the new spreadsheet. John Walz, House Fiscal Analyst, assisted.

Testimony was taken from the following individuals regarding the new Health Care and Human Services Division Supplemental Budget:

Carole Specktor, Advocacy and Legislative Affairs Director, Children's Defense Fund

Deb Konechne and Tasha Jackson, Welfare Rights Committee

Mary Krinkie, Minnesota Hospital Association

Bruce Nelson, Executive Director, AARM

Representative Huntley returned to the table and discussion continued.

Rep. Dean moved HF 3976 be laid over until Thursday, March 27, to give the minority more time in light of the 24-hour rule and the Resolution KN-RES02 passed in Ways and Means this morning.

Discussion followed. The motion did not prevail.

Rep. Brod moved a recess for the same reason. Discussion followed. Chair Hosch explained the Division would be recessing at 4:30 for one hour, incidentally, and Representative Brod withdrew her motion.

Representative Huntley stated any new amendments should be ruled out of order.

Chair Hosch moved a recess until 5:30 and the motion prevailed.

At 6:02 p.m. Chair Hosch called the meeting back to order and Representative Thissen moved adoption of and explained the H3976A14 amendment. Discussion followed. Testifying:

There being no further discussion, the motion prevailed. The H3976A14 amendment was adopted.

Rep. Thissen moved adoption of and explained the H3976A6 amendment. The motion prevailed. The H3976A6 amendment was adopted.

Rep. Loeffler moved adoption of and explained the H3976A17 amendment. The motion prevailed. The H3976A17 amendment was adopted.

Rep. Loeffler moved adoption of and explained the H3976A22 amendment. Testifying:

Discussion continued and Representative Loeffler withdrew her H3976A22 amendment.

Representative Loeffler moved to amend the H3976DE-2 amendment as follows:

Delete Section 1 of Article 2 beginning on page 13, line 13.17 through
line 21.20 on page 21

Discussion followed. The motion prevailed.

Rep. Abeler moved adoption of and explained the H3976A21 amendment and then withdrew same.

Rep. Abeler moved adoption of and began explaining the H3976A1 amendment until, at 6:27 p.m., technical difficulties were discovered with the taping equipment and Chair Hosch moved a short recess to the call of the chair until the equipment could be fixed.

At 6:30 p.m. the Chair called the meeting back to order and Representative Abeler continued his presentation of the H3976A21 amendment and then withdrew same.

Rep. Abeler moved adoption of and explained the H3976A2 [policy] amendment and then withdrew same.

Rep. Abeler moved adoption of and explained the H3976A9 amendment and then withdrew same.

Chair Hosch explained his H3976A16 amendment, and made reference to Representative Fritz' anticipated H3976A20 amendment to his A16 amendment. Testifying:

Chair Hosch withdrew his H3976A16 amendment due to the new parameters set in the Ways and Means Resolution KN-RES02 which would have made it out of order.

Representative Fritz explained her H3976A15-1 amendment and likewise withdrew it due to Resolution KN-RES02 which would have made it out of order.

Rep. Gottwalt moved adoption of and explained the H3976A8 amendment and requested a roll call vote. Chair Hosch ruled the amendment out of order.

Rep. Dean appealed the chair's ruling and requested a roll call. Discussion followed and Representative Gottwalt clarified information in the amendment. Chair Hosch withdrew his ruling that the amendment was out of order. Rep. Dean withdrew his request for a roll call vote. Following discussion, the Clerk took the roll on the H3976A8 amendment which failed 7/12/2 as follows:

Rep. Erickson moved adoption of and explained the H3976A7 amendment and offered an oral amendment as follows:

line 2.25, change "2009" to "2010"

Representative Huntley stated the H3976A7 amendment was out of order. Discussion followed. Representative Huntley moved to lay the amendment over and then withdrew his motion to lay the amendment over.

Chair Hosch ruled the H3976A7 amendment out of order.

Rep. Gottwalt moved the H3976A13-1 amendment and Chair Hosch ruled it out of order. Discussion followed and the Chair reiterated his ruling that the amendment was out of order.

Representative Huntley moved HF 3976, the DE2 amendment, as amended, be recommended to pass and returned to the Committee on Finance. Representative Anderson requested a roll call on the final bill. Discussion followed. The clerk noted the roll and the bill passed 14/6/1 as follows:
