Representative Bill Hilty, Chair, called the fortieth meeting to order at 2:47 PM on March 17, 2008 in Room 200 of the State office Building.

The Clerk noted the roll.

Rep. Slocum moved approval of the minutes of March 14, 2008. The motion prevailed. The minutes were adopted with the following amendment:

Delete "Monday, February 12" and insert "Wednesday, March 12"

Rep. Hilty moved HF995.

Rep. Knuth moved HF 3195.

Rep. Knuth presented HF 3195.

Rep. Knuth moved the H3195A28 amendment.

Rep. Knuth incorporated the following oral amendment to the H3195A28:

Page 1, Line 2, delete "8" and insert “11"
Page 1, Line 3, delete “9" and insert “12"
Page 1, Line 4, after the comma, insert “Line 21"
Page 1, Line 12, delete “17" and insert “24"

Rep. Knuth renewed her motion that the H3195A28, with the incorporated changes, be adopted. The motion prevailed. The amendment was adopted.

Rep. Gunther moved the H3195A22 amendment.

Rep. Gunther incorporated the following oral amendment to the H3195A22:

Page 1, Line 2, delete “29" and insert “32"

Rep. Gunther renewed his motion that H3195A22, with the incorporated changes, be adopted.

Rep. Gunther requested a roll call vote.

The Committee Legislative Assistant took the roll on the H3195A22 amendment.

Those voting in the affirmative were: Beard, Gunther, Hackbarth, Nornes, Ozment, and Westrom.

Those voting in the negative were: Hilty, Bly, Brynaert, Gardner, Johnson, Kalin, Knuth, Peterson, Sailer, and Welti.

There being 6 ayes and 10 nays, the motion did not prevail.

There being 6 ayes and 10 nays, the motion did not prevail.

Rep. Westrom moved the H3195A21 amendment.

Rep. Westrom incorporated the following amendment to the H3195A21 amendment:

Page 1, Line 2, delete “29" and insert “32"

Rep. Westrom requested a roll call vote.

Rep. Westrom incorporated the following changes into the H3195A21:

Page 1, Line 2, after “lowered" insert “for utilities participating in a cap and trade program implemented in Minnesota, provided that all resulting tax savings are used to reduce rates to energy consumers"

Rep. Westrom laid over the H3195A21 temporarily to work with counsel on amendment language.

Rep. Hackbarth moved the H3195A24 amendment.

Rep. Hackbarth incorporated the following changes to the H3195A24 amendment:

Page 1, Line 1, delete “1" and insert “2", and delete “21" and insert “1"

Rep. Hackbarth requested a roll call vote.

The Committee Legislative Assistant took the roll on the H3195A24 amendment.

Those voting in the affirmative were: Beard, Gunther, Hackbarth, Nornes, and Westrom.

Those voting in the negative were: Hilty, Bly, Brynaert, Gardner, Johnson, Kalin, Knuth, Peterson, Sailer, Wagenius, and Welti.

Those abstaining or absent were: Hoppe, Magnus, Ozment, Ruud, and Slocum.

There being 5 ayes and 11 nays, the motion did not prevail.

Rep. Westrom renewed his motion to adopt the H3195A21 amendment.

Rep. Westrom moved to delete the previous incorporation and instead incorporate the following changes to the H3195A21 amendment:

Page 1, Line 2, after “lowered" and insert “for utilities"
Page 1, Line 4, before the period, insert “provided that all resulting tax savings are used to reduce rates to energy consumers"

The Committee Legislative Assistant took the roll on the H3195A21 amendment.

Those voting in the affirmative were: Beard, Gunther, Hackbarth, Nornes, and Westrom.

Those voting in the negative were: Hilty, Bly, Brynaert, Gardner, Johnson, Kalin, Knuth, Peterson, Sailer, Wagenius, and Welti.

Those abstaining or absent were: Hoppe, Magnus, Ozment, Ruud, and Slocum.

There being 5 ayes and 11 nays, the motion did not prevail.

Rep. Westrom asked for a roll call on the final vote on the bill.

Rep. Knuth renewed her motion that HF 3195, as amended, be recommended to pass, and returned to the committee on Finance.

The Committee Legislative Assistant took the roll on HF 3195.

Those voting in the affirmative were: Hilty, Bly, Brynaert, Gardner, Johnson, Kalin, Knuth, Ozment, Peterson, Sailer, Wagenius, and Welti.

Those voting in the negative were: Beard, Gunther, Hackbarth, Nornes, and Westrom.

There being 12 ayes and 5 nays, the motion prevailed. The bill was passed.
