MINUTES


Representative Carlos Mariani, Chair of the E-12 Education Committee, called the twelfth meeting to order at 8:05 AM on Thursday, February 22, 2007, in the basement hearing room of the State Office Building.


The Committee Legislative Assistant noted the roll:

Rep. Heidgerken moved that the minutes of February 20, 2007 be adopted. THE MOTION PREVAILED.


HF 803 (Benson)


Chair Benson moved that HF 804 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the K-12 Finance Division.

Rep. Benson moved H0803A1 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Benson presented HF 803, as amended.

Testifying on behalf of HF 803, as amended, were:

Questions and discussion followed.


Rep. Benson renewed his motion that HF 803, as amended, be recommended to pass and re-referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division. THE MOTION PREVAILED.


HF 988 (Winkler)


Chair Mariani moved that HF 988 be recommended to pass and be re-referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division.

Chair Mariani moved A07-0100 delete-all amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Mariani moved the H0988A1 amendment to the A07-0100 amendment.

Questions and discussion followed.

Mr. Shepard from House Research testified about the H0988A1 amendment, relating to the rulemaking exemption provision and whether such language sets a precedent.

House Research staff offered to amend the H0988A1 amendment to the A07-0100 amendment.

Chair Mariani requested to hear testimony on HF 988 while House Research Staff worked out the wording to the oral amendment.

Rep. Winkler presented HF 988, as amended.

Testifying on behalf of HF 988, as amended, were:

Mr. Patrick Plant, Director of Technology and Information Services, Anoka-Hennepin School District.
Mr. Doug Johnson, Director of Media and Technology, Mankato Public Schools
Ms. Cathy Wagner, Director of Information Technologies, Minnesota Department of Education

Questions and discussion followed.

Chair Mariani moved to orally amend the H0988A1 amendment to the A07-0100 amendment as follows:

Page 1, Line 4 Delete "Exemption from"
Page 1, Line7 Delete "without following" and insert "under"
Page 1, Line 7 to Line 8 Delete “Chapter 14, and Minnesota Statutes, section 14.386, does not apply" and insert “section 14.389. Section 14.389, subdivision 5 applies to these rules."

THE MOTION PREVAILED. THE AMENDED AMENDMENT WAS INCORPORATED.

Chair Mariani renewed his motion that HF 988, as amended, be recommended to pass and
re-referred to the Committee on Finance with a recommended re-referral to the K-12 Finance Division. THE MOTION PREVAILED.


HF 1080 (Morgan)


Chair Mariani moved that HF 1080 be recommended to pass and re-referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division.

Rep. Morgan presented HF 1080.

Questions and discussion followed.

Chair Mariani renewed his motion that HF 1080 be recommended to pass and re-referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division. THE MOTION PREVAILED.
